RESOLUTION NO. 95--4
A RESOLUTION OF THE TIGARD CITY COUNCIL AUTHORIZING THE APPOINTMENT OF A
REPRESENTATIVE FROM THE CITY COUNCIL TO SERVE ON THE METROPOLITAN AREA
COMMUNICATIONS COMMISSION NEGOTIATING POLICY COMMITTEE.
WHEREAS, the Metropolitan Area Communications Commission M.A.C.C.) Board upon
the advise of the member City Attorney's and MACC staff have unanimously
recommended that MACC renegotiate the Cable Television Franchise Agreement
with Storer Metro per their letters of April 1., 190F_ and April 11, 1985;
WHEREAS, any change in the Tigard Franchise requires approval of the Tigard
City Council and that renegotiations by MACC shall not commence until after
consent has been given by all the member jurisdictions;
WHEREAS, legal opt ons al>o continue to be developed by MACC, County Counsel
and the member jurisdiction City Attorneys;
WHEREAS, authorization to explore options and renegotiate does not mran prior
approval of any changes nor does it preclude litigation or other options; and,
WHEREAS, it is in the public_ interest to have a truly workable and enforceable
Franchise Agreement, and that negotiations are generally preferable to
litigation;
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. Authority to Renegotiate the City's Cable Franchise Agreement is
granted by City Council to MACC, however the City reserves the right to
rescind this authority by Resolution, to enforce or litigate the current
�.. Agreement, and to approve or reject any renegotiation agreement; and,
Section 2, The City's Negotiating Policy Committee Representative on the MACC
