RESOLUTION NO. 83- ,;Z
A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN McDONALD ACRES SUBDIVISION, SUBJECT TO HEREIN SPECIFIED
CONDITIONS.
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to
install streets, sidewalks, street lights, curbs, storm sewers, sanitary
sewers, underground utilities and other public facilities for the development
of subdivisions; and
WHEREAS, the City further required the payment of fees and the execution
of a Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance
Bond, the City Council agrees to accept the public improvements,
subject to the requirements for correction of deficiencies and
maintenance for a period of one year ...";
WHEREAS, said Certification has now been received by the Department of
Public Works that all requirements of the Subdivision Compliance Agreement
have been met except for the following:
1. The sidewalks and driveway aprons need to be installed;
_ 2. The A.C. overlay needs to be placed on the streets;
WHEREAS. a maintenance bond is on file with the City and remains in full
effect throughout the maintenance period.
1,10W, HEREFORE
BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby-
accepts the public improvements constructed within McDonald Acres Subdivision,
said subdivision being recorded in Book 55 on Page 24 in Washington County,
Oregon, Plat records, subject to:
I. The installation of the sidewalks and driveway aprons.
2. The placement of the AC overlay on the streets, and
3. Any other maintenance items which may arise under the maintenance
agreement.
