Resolution No. 83-52 9 CONTRACT REVIEW BOARD CITY OF TIGARD, OREGON RESOLUTION NO. 83-! A RESOLUTION OF THE TIGARD CITY COUNCIL AUTHORIZING THE PURCHASE OF REPLACEMENT VEHICLES UNDER THE AUTHORITY OF SECTION 4 OF THE TIGARD CONTRACT REVIEW BOARD RULES. WHEREAS, under Ordinance No. 76-3 the City Council of the City of Tigard is designated the Local Contract Review Board for the City and has adopted Rules under Resolution 77-5; and WHEREAS, there is a need to replace two obsolete mid-size vehicles assigned to the Police Department as soon as possible; and WHEREAS, an investigation by the Tigard Chief of Police has revealed, among other things: (1) There are no new or used mid-size vehicles available under existing governmental contracts at this time; and, (2) Vendors are reluctant to formally bid on existing new or used vehicles, as their stock probably will not be available at the time bids are awarded; and (3) A price survey from vendors in the region on like mid- size used vehicles has identified the best product and cost savings for the City. See Report of Chief of Police, Exhibit "A", attached hereto and by this reference made a part hereof. NOW, THEREFORE, BE IT RESOLVED BY THE TIGARD CITY COUNCIL: Section 1. Based on the results of the investigation of the Chief of Police, the City Council makes the following findings: (1) The purchase of used vehicles from a specific vendor will not result in favortism, because price and the quality of the product were the criteria utilized in the Chief's findings; or 3 (2) The purchase will not substantially diminish competition because the situation is unique, occurring just before a new model year and with insufficient time to deal with 1983 model vehicles should the normal bidding process be required; and (3) The purchase will result in substantial cost savings, as the Chief has found, especially with anticipated cost increases for 1984 vehicles. The City Council delcares the following two vehicles as surplus to be traded In on the above two replace- ment vehicles: (1) 1973 Cougar, Serial No. 3F93H515756 (2) 1975 Cougar, Serial No. 5A935514570 Section 3. The City Council, acting as the Contract Review Board, authorizes the purchase of two used vehicles in the amount of $13,800 (1981 & 1982 Chevrolet Monte Carlos) from Knauss Chevrolet under Sections 4(1) and (2) of the Local Contract Review Board Rules. The cost estimates of 1984 vehicles are estimated to be $9,000 to $9,500 each, three to four thousand dollars over the $15,000 appropriation. 4. There are no other new or used mid-size vehicles available under existing governmental contracts. 5. Vendors (Car Dealers and National Car Rental Firms) are reluctant to formally bid on existing new or used vehicles, as their stock probably will not be available when the bids are awarded. 6. Local dealers in the region will allow the City to trade in obsolete vehicles at the time of purchase from their stock, which will reduce the capital outlay cost. dr 7.
