RESOLUTION NO. 83--l-I
A RESOLUTION OF THE TIGARD CITY COUNCIL AUTHORIZING THE PURCHASE OF USED EQUIPMENT
UNDER THE AUTHORITY OF SECTION 3 AND SECTION 4 OF THE TIGARD CONTRACT REVIEW BOARD
RULES.
WHEREAS, under Ordinance no. 76-3 the City Council of the City of Tigard is
designated the LOCAL CONTRACT REVIEW BOARD for the City and has adopted Rules under
Resolution 77-5; and
WHEREAS, there is a need for certain equipment specified below for use by the
Public Works Department; and
WHEREAS, the equipment requirr i by thr City of Tiljor:l in hides:

(2) a 1 ton service truck, new or in excellent. condition,
(3) a 5 yard dump truck, in new or in excellent condition,
WHEREAS, an investigation by the Public Works Director has revealed, among
other things: Upon checking with 17 local vendors and verifying the cost of new
equipment vs used equipment with them, it was determined to try to purchase used
equipment. See Report of Operations Superintendent, Exhibit "A", attached hereto
and by this reference made a part her-of.
NOW, THEREFORE, BE I`T` RESOLVED BY THE TIGARD CITY COUNCIL:
Section 1: Based on the results of the investigation of the Operations Supt. ,
the City Council makes the following findings:
(1) The cost of the above described equipment which is used is substantially
less than the cost of comparable new equipment, and
(2) Used equipment of the type and condition required is in extremely limited
supply, no other dealers within the Portland metropolitan area having any when
contacted, and
By this resolution does exempt the purchase ofthe above described equipment
from competitive bidding under Section 3 (10) Single seller of price of product
required of the Local Contract Review Board Rules,
Section 2: Based on the results of the investigation of the Operations Supt.,
the City Council makes the following findings:
(1) The purchase of used vehicles from a spocif u- vendor will not result in
favoritism because the local vendors were all contacted and the units availabir
were not adequate or in good enough condition; '®
(2) The purchase will not substantially diminish competition because allthe
localvendors were contacted, either by phone or personal visit, and
(3) The purchase will result In substantial cost savings because used equipment
is less espensive than new and equipment in exceptionally good condition requires
less maintenance than comparably priced used equipment not in comparable condi-
tion.
And by this resolution does exempt the purchase of the above described _,quipmr,tit
from competition bidding under Section 4 of the Local Contract Review Board Rules.

Section 3: The City Council, acting as the Contract Review Board, authroizes
the purchase of:
(1) 1973 Ford tractor with articulated arm mower for $ 5,000 from E.P.C. Co.
(2) 1981 Ford 1 ton service truck for 10,875 from Coast Crane
(3) 1978 International 5 yard dump truck for 13,500 from Colombia Body
for a total of: $35,625-

SUBJECT: Used Equipment Purchase
The following are the descriptions of the three used items I have investigated
and recommend for purchase:
1. A 1973 Ford tractor with an articulated arm mow-r; it is exception—
ally clean and free from breaks and cracks in the frame structure. Replace—
ment value is approximately $32,000. The cost savings and condition of the
mower are exceptionally good. All service records are available on this unit.
2. F. 1981 Ford 1 Ton service truck with 9,600 miles; it is exceptionally
clean, has low miles, a 9 foot full service utility body and is in like new
condition. This particular unit is ready for service with no repairs neces—
sary.
3. A 1978 International 5 yard dump truck; exceptionally clean and in good
condition with 36,000 miles. It has not been used in construction and is free
hk® of dents and structural damage which ordinarily occurs in dump trucks. Re—

placement value is approximately $30,000.

These units are very hard to find in such good condition. I have spent several
weeks reviewing the possibilities and can highly recommend these units as the
best use of the monies for value recieved.
The City of Tigard .Contract Review Board Rules cite the following in allowing the
purchase of single seller products:
Section 3 (10) Single seller or price or product required. Contracts for
purchase where there is only one seller or price of a product of the quality
required available within a reasonable purchase area.
Section 4 (1) & (2) Exemptions for additional contract. The board may, by
resolution, exempt other contracts from competitive bidding if it finds:
1. the lack of bids will not result in favoritism or substantially
diminish competition in awarding the contract; and
2. the exemption will result in substantial cost savings.
