A RESOLUTION CALLING FOR PUBLIC HEARING TO DETERMINE THE FINAL COST OF STREET
AND SEWER IMPROVEMENTS IN THE SOUTHWEST HAMPTON STREET LOCAL IMPROVEMENT
DISTRICT (LID 1122) TO RATIFY AND ADOPT THE APPORTIONMENT AND ASSESSMENT OF �
THE COST1O RESPECTIVE PARCELS OF LAND WITHIN THE DISTRICT, �O SPREAD THE �
ASSESSMENT AND DIRECT THE ENTRY OF ASSESSMENT IN THE LIEN DOCKET.
WHEREAS, The Council has, by Ordinance No. 81-08 on February 23, 1981,
authorized and directed that the sewer and street improvements within the
boundaries of the S.W. Hampton Sanitary Sewer and Street Local Improvement
District (LID 1122), as bounded and described in Resolution 81-07, be
undertaken by contract, and that that work has now been completed; and
WHEREAS, The Council declares that the total final assessable costs of
the improvements within the boundaries of the Improvement District is the sum
of $471,490.91 and the Council further finds that all lots, parcels or parts
of lots within the boundaries of the District as defined in Resolution 81-07
are specially benefited and together shall bear equitable shares of the cost
of the improvement; and
WHEREAS, The Council further finds that the apportionment of the cost of
the improvement upon each lot, part of lot or parcel, as prepared by the City,
and as set forth in the attached schedule, entitled "S.W. Hampton Sanitary
Sewer and Street Local Improvement District 1122," which by reference is made a
part of this Resolution, is according to the special_ and peculiar benefits
accruing to each from the improvements; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TIGARD
AS FOLLOWS:
Lection 1: That the City Council does hereby deem it expedient and
necessary, and does hereby declare its intention to make final assessments on
the aforesaid portion of SW Hampton Street.
Section 2: The Council further finds that the City Recorder of the City
of Tigard be, and she is Hereby, directed to give notice by mail or cause to
be personally delivered to the owner of each lot or tract proposed to be
assessed a notice of assessment, which notice shall state the amount of the
assessment proposed on that property and also state a date by which time
objections should be filed with the City Recorder.
Section 3: That Monday, the 16th day of August, 1982, at the hour of 7:30
P.M., at Fowler Junior High School Lecture Room, 10865 SW Walnut, Tigard,
Oregon, be and the same are hereby set as the time and place for hearing and
considering objections or remonstrances to the proposed improvement by any
parties aggrieved thereby. The City Council at that time shall determine the
assessment to be properly apportioned according to L.,e special and peculiar

benefits accruing to each parcel, part of lot, or lot within the Improvement
District. Each lot, parcel, or part of lot is designated in the attached
apportionment schedule as herein attached and made a part of this resolution. E

Section 4: That the City Recorder be, and sh;, is hereby, directed to
publish a notice of the hearing in the Tigard Times, issue of August 5, 1982.
Section 5: Within ten days from the date of the publication of the notice

Improvement No. 22. As of July 31, 1982, the final cost is $471,490.91.
The apportionment for the project is as follows:
City of Tigard (15 percent) $ 64,630.37
Hampton Street Tax Lots 366,238.78
67th Avenue Tax Lots 4C,621.76
Total $ 490.91
The only change in the assessment method was t.; change the apportionment
of assessment on 67th Avenue- In the initi.e.I Public Hearing, the
Portland Farmers Insur=-;ce Group Federal Credit Union requested that
assessments be based on area rather thar Frontage.

WHEREAS, by authority of Section 18.84.030 (D) of the Tigard Municipal (.
Code (TMC) the City Council may initiate the Comprehensive Plan Revision and �

INOW, THEREFORE,
Be it resolved by the City Council of the City of Tigard, a municipal corporation
of the State of Oregon that:

Section l: The Council, pursuant to Section 18.84.030 (d) of the Tigard
Municipal Code (TMC) hereby initiates proceedings for a
comprehensive plan revision to Commercial-Retail and Zone Change to C-3 (General #
C^w„erc_al) for the Greenway Town Center.
Section 2: The Council directs the Neighborhood Planning organization

(NPO #7) and the Planning Commission to review the Comprehensive
Plan Revision and Zone Change, and sulenit their recommendation to the City Council
pursuant to Section 18-84-070 (b) and 18.84-100-
