RESOLUTION NO. 82- 73
ALUTI cc CONCERNING VACATION OF A PORTION OF S.W. 72nd AVENUE, A

DEDICATED PUBLIC RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHINGTON
COUNTY, OREGON.
WHEREAS, the area described on the attacher sheet headed "Exhibit A"
and by this reference made a part hereof, is an undeveloped unused
portion of street dedicated to the public for highway purposes; and
WHEREAS, the area described on said Exhibit "A" lies within -` e
corporate boundaries of the City of Tigard, Oregon; and
WHEREAS, said described area does not serve a public highway purpose
and is so situated as to be of no usefulness now or in the future as
part of the public street system of the City; and
WHEREAS, the party which will accrue property by virtue of the va^_ation
has dedicated, at no cost to the City of Tigard, another right•-of-way parcel
necessary in the completion of L.I.D. 21 S.W. 72nd Avenue Area Street
Improvement; and
WHEREAS, it appears to be in the public interest that the said area
be vacated and restored to the tax rolls and made available for develop-
ment and use; and
WHEREAS, pursuant to Chapter 271.130 ORS, the City governing body
is initiating vacation proceedings as authorized in Chapter 271 ORS.
NOW, THEREFORE,
BE IT RESOLVED by the City Council of Tigard as follows:
(1) "That the public hearing is hereby call_:�d to be held by the City
Council of Tigard on Monday, August 23, 1982, at Fowler Junior High
School Lecture Room, 10865 S.W. Walnut Street, within the City of Tigard,
beginning at 7:30 P.M., at which time and place the C3uncil shall hear
any objections thereto, and any interested person may appear and be
heard for or against the proposed vacating of said lands."
(2) "That the City Recorder be, and she is hereby, authorized and
directed to cause to have published in the Tigard Times, a newspaper
of general circulation in the City of Tigard hereby designated for
such purpose, a notice of said hearing in the form hereto attached
and by this reference made a part

T.2S., R_1W., W.M., City of Tigard, Washington County, Oregon more
particularly described as being that part of the tract previously
dedicated to the public and described in Fee No. 78-045494 of the
Records of Washington, Oregon that lies northeasterly of a line that
is northeasterly 30 feet at right angles and parallel to the following
described centerline:
Beginning at a stone southline of said Section 1 that marks
the southwest corner of the southwest 4 of the southwest 4
of said Section 1 also being Point "B" o8 County Survey No.
13,247; thence along the centerline N 59 07'51" W 582.413
feet to the beginning of a 350-foot radius curve to the right
(a stone in a monument box at the easterly S.E. corner of the
W.W. Graham D.L.C. is N 59007'51" W, 202.156 feet); thence
o rth,westerly along slid 350-foot radius curve to the right through
acentral angle of 60 01'14" 366.645 feet to the end of said

of curve point is N 0 53'23" E, 202.156 feet from said stone in

ON PROPOSED VACATION OF A PORTION OF S.W. 72nd AVENUE, A DEDICATED
PUBLIC RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHTNGTG,,, COUNTY, OREGON-
Pursuant to "resolution No. 82- 730f the Cit;; Council of Tigard, adopted July
12, 1982, under authority of Chapter 271.130 Oregon Revised Statutes, a public
hearing will be held by the Council of Tigard at 7:30 P.M. on Monday, August
23, 1982, at Fowler Junior High School, Lecture Room, 10865 S.W. Walnut Street,
Tigard, Oregon, with respect to the proposed vacation of the following described
portion of S.W. 72nd Avenue, a dedicated public right-of-way in the City of
Tigard, Washington County, Oregon.

Dear Frank:
Attached is a map and legal description of property to be vacated
to Pacific Western Bank as a part of the right-of-way acquisition
process for the 72nd Avenue project.
Also attached is a list of owners of real property affected which
must be notified as prescribed by ORS 271.080.
Because of greater simplicity, we recommend the vacation be "on
council's own motion" per ORS 271.130.
