CITY OF TIGARD, OREGON
RESOLUTION NO. 82- 71
A RESOLUTION CONCERNING VACATION OF PORTIONS OF S.W. 72nd AVENUE,A DEDICATED
PUBLIC RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
WHEREAS, the areas described on the attached sheet headed "Exhibit A"
and by this reference made a part hereof, are undeveloped unused portions of
street dedicated to the public for highway purposes; and
WHEREAS, the areas described on said Exhibit "A" lie within the
corporate boundaries of the City of Tigard, Oregon; and
WHEREAS, said describcd areas do not serve a public highway purpose and
are so situated as to be of no usefulness now or in the future as part of
the public street system of the City; and
WHEREAS, each of the parties which will accrue property by virtue of
the vacation are dedicating; at no cost to the City of Tigard, other right--
of-way parcels necessary in the completion of L.I.D. 21 - S.W. 72nd Avenue
Area Street Improvements; and
WHEREAS, it appears to be in the public interest that the said areas
be vacated and restored to the tax rolls and made available for development
and use; and
WHEREAS, pursuant to Chapter 271.130 ORS, the City governing body is
initiating vacation proceedings as authorized in Chapter 271 ORS.
NOW, THEREFORE,
BE IT RESOLVED by the Ciiy Council-of Tigard as follows:
(1) "That the public hearing is hereby called to be held by the City
Council of Tigard on Monday, August 23 1982, at Fowler Junior High
School Lecture Room, 19865 S.W. Walnut Street, within the City of Tigard,
beginning at 7:30 P.M., at which time and place the Council shaii hear
any objections thereto, and any interested person may appear and be
heard for or against the proposed vacating of said lands."
(2) "That the City Recorder be, and she is hereby, authorized and dir-
ected published the Tigard Times_ a newspaper of

general circulation in the City ofTigardhereby designated for such
purpose, a notice of said hearing in the form hereto attached and r
by this reference made a part hereof, the first publication to be
made on the 22,d-day of July 1982 and once each week thereafter :'
for five pubiishings in all."

"The Recorder be, avid she is hereby, further directed to cause to have
_ posted within five (5) days after the date of first publication, a copy
of said notice in the form hereto attached, at or near each end of the
ureas proposed to be vacated, and in addition, the Recorder shall post
a copy of said ncc'ce in at least two (2) conspicuous places within
the areas proposed to be vacated, all of said postings to be accomplished
dit4in the time herein stated." ■
(3) "That the particular portions of dedicated street proposed to be
vacated are described on the attached sheet headed "Exhibit A" and by
this reference made a part hereof."

County, Oregon that is easterly from a line 30 feet easterly at right
angles and parallel to the centerline of County Road No. 922 (as
shown on County Survey No. 19,127).
Contains 16,464 Square Feet more or less.
Also that portion of that parcel conveyed the State of Oregon described
as Parcel 3 in Book 931, Page 497 and 498 of the Records of Washington
County, Oregon that is westerly from a line 30 feet westerly at right
angles and parallel to the centerline of County Road No. 922 ( as
shown on County Survey No. 19,127).

ON PROPOSED VACATION OF PORTIONS OF S.W. 72nd AVENUE, 1 DEDICATED
PUBLIC RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
Pursuant to resolution No. 82--71 of the City Council of Tigard, adopted
July 12, 1982, under authority of Charter 271.130 Oregon Revised Statutes,
a public hearing will be held by the Council of Tigard at 7:30 P.M., on
Monday, August 23, 1982, ac Fowler Junior High School, Lecture Room,
10865 S.W. Walnut Street, Tigard, Oregon, with respect to the proposed
vacation of the following described portions of S.W. 72nd Avenue a ded-
icated public right-of-way in the City of Tigard, Washington County,
Oregon.

Dear Frank:
Attached is a proper resolution map and legal description of property to
be vacated to Washington County and Bingham Investment as part of the right-
of-way acquisition process for the 72nd Avenue project.
Also attached is a list of owners of real property affected which must be
notified as prescribed by ORS 271.080.
Because of greater simplicity, we recommend the vacation be "on council's
own motion" per ORS 271.130. The resolution also provides that the vacation
ordinance will not be effective until other right-of-way under the control
0 of Washington County and Bingham Investment, and necessary for the -improvement r
of the 72nd Avenue project, is dedicated to the City of Tigard at no cost
to the City.
