Resolution No. 82-58 '7, f CITY OF TIGARD, OREGON RESOLUTION No. 82-_.5'L A RESOLUTION REQUESTING A SIX-MONTH EXTENSION TO THE JUNE 25, 1982 RENEWAL DATE IN THE PORTLAND WATER SALES CONTRACT. WHEREAS, the City of Tigard is responsible under State law for developing the Comprehensive Plan for the City and, as a part of this responsibility, for assuring the provision of all public facilities necessary to implement the Plan; and, WHEREAS, the City of Tigard is concerned with the long-term economic development health of the community, and the provision of a dependable and affordable supply of water to the community is essential to a healthy economy and community; and, WHEREAS, the City of Tigard has the authority under ORS 199.510 (2) to withdraw from a water district and provide water service directly; and, WHEREAS, the City of Tigard is concerned with the lack of a long-term water sup- ply from the Tigard Water District, and the City of Tigard is concerned with the cost of water service which may be more economically provided as a part of the City's other operations; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TIGARD, THAT: 1. The City of Tigard requests a six-month extension to the current June 25, 1982 renewal date in Contract No. 16031 between the City of Portland and the Tigard Water District. 2. The extension is requested to be granted solely to the City of Tigard to provide the City of Tigard sufficient time to analyze and evaluate the needs and faci- lities of the water system and translate them into long-term legal commitments for its customers. 3. Specifically, the City of Tigard requests a waiver of Section 12, Contract Renewal, in Contract No. 16031 through December 25, 1982 be granted to the City of Tigard, and that the City of Tigard be allowed until December 25, 1982 to enter into a Water Sales Contract with the City of Portland without the growth impact charge penalty payments. 4. Prior to December 25, 1982, the City of Tigard will complete necessary engineering studies, meet with the Water Manager's Advisory Board, conduct public meetings, pass the enabling ordinances, and sign a Water Sales Contract between the City of Portland and the City of Tigard for some percentage of its water needs.
