RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEtIENTS CONSTRUCTED
WITHIN AMES ORCIiARD SUBDIVISION.
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to
install streets, sidewalks, street lights, curbs, storm sewers, sanitary sewers,
underground utilities and other public facilities for the development of subdivisions;
and
WHEREAS, the City normally requires the payment of fees and the execution of
a Compliance Agreement, for subdivisions developed within the City, which stipulates
that:
"Upon receipt of certification by the Department of Public Works tnat
all requirements have been met and a One Year Maintenance Bond, the City
Council agrees to accept the public improvements, subject to the requirements
for correction of deficiencies and maintenance for a period of one year...;
and
WHEREAS, Ames Orchard Subdivision was developed within Washington County and,
prior to completion, has been annexed to the City; and, subsequently, the facilities
therein are proposed in accord with Council Resolution No. 79-116, to become a
city maintenance responsibility; and
WHEREAS, in light of all of the aformentioned an acceptable Maintenance
Bond has been on file with the City, subject to the aforsaid normally required
maintenance period for one year; and
WHEREAS, ALL DEFICIENCIES THEREIN HAVE NOW BEEN CORRECTED,
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of TiEard, Oregon hereby
accepts the public improvements (except the L.I.D. County Storm Drainage facility)
constructed within Ames Orchard Subdivision, said subdivision being recorded in Book
^9 on Page 37 in Washington County, Oregon, Plat Records.
AND FURTHER, the City Council herewith authorizes release of the aforsaid
Maintenance Bond.
