RESOLUTION No. 78-58
A RESOLUTION OF THE TIGARD CITY COUNCIL PLACING ON THE BALLOT FOR THE NOVEMBER 7, 1978
GENERAL ELECTION A PROPOSAL FOR A CHARTER AMENDMENT ESTABLISHING AN INCUMBENT
CANDIDATE RULE.
The City Council of the City of Tigard hereby resolve
The following proposed amendment to the Charter of the City of Tigard shall be
placed on the ballot at the general election to be held November 7, 1978. The
amendment, if approved by a majority of the voters, shall be added to Section VII
of the Charter. The language of the proposed amendment is the following:
No person who is serving as mayor or councilman shall
become a candidate for any city office for a term which would
be concurrent with his term in the office he then holds unless
he first submits a written resignation from his then-current
office. A resignation submitted for the purpose of satisfying
the provisions of this section shall recite that it is given for
the purpose of permitting its signer to be a candidate for office.
A resignation submitted to satisfy this section shall not be
withdrawn. The resignation shall be adequate for purposes of this
section if it provides for the termination of the signer's service
in the office not later than the last day before his service would
begin in the office for which he seeks to become a candidate.
In the event the office of mayor or councilman becomes vacant
180 days or more before the normal expiration of its term a special
election shall be held to fill the office for the unexpired term.
Such an election shall be held within 45 days of the occurrence of
the vacancy. All nominating papers comprising a petition shall be
assembled and filed with the recorder as one instrument not later
than 20 days before the special election. If, however, a state-wide
primary or general election falls within the 180-day period following
the occurrence of the vacancy, then no special election shall be held.
The proposal shall be submitted to the voters under the explanatory
language "Charter Amendment Submitted to the Voters by the City Council," and under
the following ballot title:
"Incumbent Candidate Rule.
Requires Advance Resignation of Incumbent Mayor or Councilman Who Runs
For Term In City Office Which Would Be Concurrent With Unexpired Term."
