Resolution No. 78-57 CITY OF TIGARD, OREGON RESOLUTION NO. 78-.5 A RESOLUTION PLACING ON THE BALLOT FOR THE NOVEMBER 7, 1978 GENERAL ELECTION A PROPOSAL FOR AN ORDINANCE ESTABLISHING A RESIDENCY REQUIRE- MENT FOR CITY DEPARTMENT HEADS. THE CITY COUNCIL OF THE CITY OF TIGARD HEREBY RESOLVES: The following proposed ordinance of the City of Tigard shall be placed on the ballot at the general election to be held November 7, 1978. This ordinance, if approved by a majority of the voters, shall be added to the Municipal Code of the City of Tigard as a part of Title II, "Administration and Personnel." The language of the proposed ordinance is the following: Section 1: All persons employed full-time by t:le City of Tigard in the positions named in this ordinance are hereby required to establish permanent residency within the city limits or within the area designated as Tigard's Immediate Urban Growth Boundary within 120 days following appointment. The affected positions are the following: City Admini- strator, City Recorder, Chief of Police, Planning Director, Public Works Director, City Engineer, Head Librarian, and City Building Official. Any person hired or appointed to be the chief administrative officer of any other department of the City hereafter created shall also be required to comply with the terms of this ordinance. Section 2: Persons presently employed in the affected positions shall not be required by this ordinance to establish res=dency within the Urban Growth Boundary of the City of Tigard. Section 3: The City Council may at its discretion extend the period for compliance with this ordinance an additional 30 days. Such an extension may be given to any affected employee if that employee has made a demonstrable effort to comply by arranging for the purchase of a home within the city limits before the end of the applicable period, and the delay preventing full compliance is caused only by the delay in completing any required real estate transaction, and that delay does not arise on account of any fault of the employee. 1,. z Section 4- Failure to establish residency within the required area within the time allowed by this ordinance shall result in immediate termination of employment by the City of Tigard. Section 5• For the purposes of this ordinance the term "Immediate Urban Growth Boundary" shall mean the Urban Growth Boundary approved and adopted with regard to the City of Tigard by the Oregon Land Conserva- tion and Development Commission. If, however, at any relevant time the City Council of the City of Tigard has reviewed and approved an Urban Growth Boundary that is different from the boundary recognized by LCDC, for whatever purpose, the City Council may choose (but is not required) to make that boundary, rather than the LCDC-approved boundary, a test for compliance with this ordinance. The proposal shall be submitted to the voters under the explanatory language "Referendum Ordered by the City Council," and under the following ballot title: "The Department Heads Residency Requirement. Requires that Department Heads, City Administrator, and City Recorder reside in Tigard."
