RESOLUTION No. 77-1q
A RESOLUTION OF THE CITY COUNCIL ACKNOWLEDGING RECEIPT OF TRIPLE MAJORITY
�a ANNEXATION AND RECOMMEND FORWARDING TO PORTLAND METROPOLITAN AREA LOCAL
GOVERNMENT BOUNDARY COMMISSION.
n`! WHEREAS, the City of Tigard has received and reviewed a petition
for annexation of the lands described on the attached Exhibit "A" to
the City; and
WHEREAS, the petition has been processed in accordance with the
procedures established by the Portland Metropolitan Area Local
Government Boundary Commission; and
WHEREAS, the petition meets the requirements of the triple
majority annexation statute,
NOW,THEREFORE,
BE IT RESOLVED: The Tigard City Council acknowledges receipt
of annexation petition as attached hereto and made a part hereof
and recommends it be forwarded to the Portland Metropolitan Area
Local Government Boundary Commission for hearing and adoption.

Dear Mr. Walden;
C. & C. Construction Co. desire to build a facility for retire-
ment apartments. This facility will have approximatel- 90 apartments
with a central lau:.dry, dining room and kitchen facilities.
The property Ave desire to purchase is located at the corner of
S. W. Bend Rd. & S. W. Pacific Highway. It consists of approximately
4.35 acres and is Tax Lot 2S 1 10A. .T. L. #3900.
This property is not presently annexed to the City of Tigard,
however, it is our desire to have it annexed. We have spoken to Dick
Bowen and Arline O'Leary in regard -to annexatior_.
In as much as the property is not in the present sewer basin,
John S. Hagman stated that we should write to the city council re-
questing the City of Tigard to allow us to run a sewer line from the
subject property and connect with the City of Tigard sewer system,
near Bull Mt. Road,
We are hereby requesting permission to connect a private sewer
line to the City of Tigard sewer system. In as much as this will be
a private line, if this request is granted, we will agree to maintain
the line & pump station until the sewer is available in the area of
the subject property and we further commit the property to annexation.

Wenatchee, Washington concerning proposed annexation to

REPORT: A Resolution has been prepared (Resolution N. 77- )
for Council action. Appropriate maps have been assembled.
(see enclosures).
A Petition for and Consent to Annexation Form has been
presented to the C & C Construction Co. for appropriate
signatures of the property owners.
Action is requested by Council relative to this issue. Please note
the conditions with regard to sewer service in this area and the
agreement on the companies part to maintain the line and pump
station.

i SUBJECT: Sanitary Sewer Service - T.L. 2900(10A) to Derry Dell Trunk
Subject to the following conditions, it is recommended
that the Council approve the connection requested.
Conditions:
1.) That the proposed pressure line .be operated
and maintained as a private service line - due to the
a limited service intent of the installation proposed
and due to the high incidence of maintenance required
by pressure systems.
2.) That the served parcel be required to disconnect
the pressure service line, if approved by the City, at
such time as a gravity flow public sewer becomes
available - due to the parcels location being within
a separate service basin than that of the trunk sewer
to which connection is proposed.
3.) That a sewer L.I.D. Nonremonstrance document
and a sewer Contract Agreement be executed - due to
the "temporary" nature of the connection (recommended)
and since the parcel is located outside of the city.
4.) That prior to issuance of a permit a mech-
anical plan and proof of right-of-way be submitted to
the City's building department.
