RESOLUTION No. 77- 77
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN ENGLEWOOD (LOTS X61-$$ ) SUBDIVISION, SUBJECT TO HEREIN
SPECIFIED CONDITIONS
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to
install streets, sidewalks, street lights, curbs, storm sewers, sanitary sewers,
underground utilities and other public facilities for the development of
subdivision; and
WHEREAS, the City has required the paSLment of fees and the execution of a
Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works that
all requirements have been met and a One Year Maintenance Bond, the
City Council agiees to accept the public improvements, subject to the
requirements for correction of deficiencies and maintenance for a
period of one year....; and
WHEREAS, said Certification has now been received, subject to correction
of hereinbelow listed deficiencies; and
WHEREAS, the subdivider has indicated a desire to retain the subdivision
performance bond in full force and effect throughout the aforesaid maintenance
period, in lieu of submitting a separate maintenance bond,
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby
accepts the public improvements constructed within Englewood Subdivision,
except for public improvement within the greenway area, said subdivision being
recorded in Book 34 on Page 29 in Washington County, Oregon, Plat Records,
subject to:
1. Completion of the required "program for development of open space"
(i.e. greenway area) and correction of deficiencies therein, by
December 31, 1977; specifically acceptable completion and/or
correction of the following;
a) Replacement of all dead or dying trees as per the approved
landscape plan.
b) Cleaning and clearing of all creek channels to remove debris,
to eliminate ponding and to cause the creek to align with and
flow through the emplaced culverts. Those culverts which are
placed in such a manner as to not accept creek flows shall be
relocated and emplaced to align with the creek bed.
; ; c) In accordance with Condition 9 of the Ordinance granting zoning
' '' approval, all sidewalks and pedestrian/bikeways within the
project shall be reconstructed at their juncture with streets

d) All pathways shall be cleared of mud and debris.

` e) Removal of all trashpiles and debris throughout the
green-way.
f) Mowing or otherwise cutting the native grasses so that at
the time of City acceptance, the greenway does not require
construction work, but rather continued maintenance only.
2. Continuation of the subdivision performance bond.
