Resolution No. 74-44 CITY Or TIGARD, OREGON RESOLUTION NO. 74-_4_ RESOLUTION OF THE TIGARD CITY COUNCIL ADOPTING A BUS PASSENGER SHELTER COOPERATIVE AGREEMENT AS PROPOSED BY THE TRI-COUNTY METROPOLITAN TRANSPORTATION DISTRICT OF OREGON (TRI-MET). WHEREAS, the Tigard City Ccttiacil finds it desirable to establish a cooperative agreement with the Tri-County Metro- politan Transit District of Oregon (Tri-Met) for the purpose of defining a bus passenger shelter locacion selection process, and WHEREAS, it is the intention of the cooperative agreement to enable the City of Tigard and Tri-Met to carry out their respon- sibilities in a timely manner, and WHEREAS, the City of Tigard and Tri-Met have mutual legiti- mate interests and concerns regarding the installation of bus passenger shelters, and WHEREAS, the City of Tigard recognizes that the installation of bus passenger shelters within its jurisdiction will be a public service benefiting the residents of the Tigard area, NOW, THEREFORE, BE IT RESOLVED, the Tigard City Council hereby accepts the Bus Passenger Shelter Agreement as proposed by the Tri-County Metropolitan Transportation District of Oregon (Tri-Met) and 'herein described by the attached exhibit "A^. Mayor —City o 'Fgarct ATTEST: 3 "4 ecorder - .ityo �gard Resolution No. 74-_✓ F to �3 EXHIBIT "All BUS PASSENGER SHELTER AGREEMENT This Agreement dated august 8 . 1974, be- tween the City of Tigard (Public Body) and the Tri- County Metropolitan Transportation District of Oregon (Tri-Met) . 1. Purpose. The purpose of this Agreement is to establish a cooperative arrangement between the Public Body and Tri-Met regarding the installation of bus passenger shelters within the jurisdiction of the Public Body. It is the intention of the Public Body and Tri-Met that each party be placed in a position to carry out its responsibilities in as timely a manner as is possible. Tri-Met recognizes that the Public Body has legitimate interests in and concerns regarding the installation of bus passenger shelters, and • the Public Body recognizes--that the installation of bus passenger shelters within-its- jurisdiction will'.be a. public . service benefiting the residents of the area. 2. Procedure for Installation of Shelters. a. Initial Site Selection. - If Tri-Met desires to install bus passenger shelters within the jurisdiction of the Public Body, it shall make 'initial site selections. After making the initial site selections, Tri-Met shall notify the Public Body in writing of the site selections. __ Page One - AGREEMENT ' E b. Public Body Reviews. - On receipt of the initial site selections, the Public Body shall review the site selections based on the following criteria: (i) . Location with reference to the location of public and private utilities. (ii) . Impact on traffic and pedestrian safety. (iii) . Effect 'on drainage. - (iv) . Location with reference to tree plantings. in the event the Public Body determines that a site is unsatisfactory based on these criteria, then the public Body shall so notify Tri-Met in writing, stating the Public = Body's basis for its determination. If the Public Body r takes no action within 30 days of receiving the initial site selection from Tri-Met, then the sites shall be deemed approved. C. • Revised Site Selections.. If the. Public Body e. notifies Tri-Met that a site is unsatisfactory, as provided ' in subparagraph (b) , then representatives of Tri-Met and f� the Public Body may meet to revise the site location. If the representatives agree on the initial or on a revised site location, then the initial or revised site shall be f • f deemed approved by the Public Body. Movement of Shelters. In the event it is necessary r Shelters be moved due to construction or reconstruction of streets, sidewalks, parking strips, or traffic islands by the Public Body, then Tri-Met shall move the Shelters at its own expense, on reasonable written notice from the f Public Body.
