A RESOLUTION OF THE TIGARD CITY COUNCIL URGING
THE GOVERNOR OF THE STATE OF OREGON AND ITS
LEGISLATORS TO CALL A SPECIAL SESSION OF THE
STATE LEGISLATURE TO AMEND CHAPTER 167
" OFFENSES AGAINST PUBLIC HEALTH AND DECENCY"
OF THE OREGON REVISED STATUTES.
WHEREAS, Chapter 167 of the Oregon Revised Statutes
titled "Offenses Against Public Health and Decency" was
adopted in 1971 by the state legislative assembly as a part
of the revised Criminal Code of Oregon; and
WHEREAS, Chapter 167 O.R.S. prohibits the City of
Tigard and all other political subdivisions of the state
from adopting and enforcing conflicting regulations; and
WHEREAS, an erosion of public morals and decency is
taking place because Chapter 167 O.R.S. provides a legal
basis upon which promoters of acts and material normally
considered offensive and indecent to the public, may carry
on their activities; and
WHEREAS, amendments to the statutes of Oregon can only
be made by the legislature which will not regularly convene
until January, 1973,
NOW, THEREFORE, BE IT RESOLVED: That the Tigard City a
Council supports and urges the Governor to call an extraordinary
special session of the state legislative assembly for the specific
purpose of preparing and adopting amendments to Chapter 167 O.R.S.
that will more effectively control the disemination, promotion
and exhibition of acts and materials of a nature offensive to
the public's health and decency; and
i HE IT FURTHER RE.^_OLVED: That the City Council urges the
members of the state legislature to support the Governor in
the call for an extraordinary legislative session, and solicits
the aid of all citizens and .Fellow elected municipal officials
in support of a united effort to accomplish the foregoing.
