ENGINEER, SETTING PUBLIC HSARING AND DIRECTING TIM GIVING OF
NOTICE TF_'REOF.
PL-MREAS, the City Council proposes to delineate a sewer
improvement assessment district for the purpose of constructing
a sewer trunk line to service the hereinafter described lands
within an area to be known as Sewer Improvement District ;132.6
(S.11. 72nd Avenue - Sanitary Sewer Extension); and
17HEREAS, pursuant to Ordinance 62-6 the City Council finds-
it
indsit expedient and necessary to order the improvement of the here-
inafter described lands by the construction of sewer trunk
facilities and pursuant thereto the City Engineer has submitted to
the Council plans, specifications, and estimates for the work to
be done and the probable costs thereof together with a statement
of the lots, parts of lots and parcels of lend to be benefited,
and the total cost of the improvements which each of such lots,
parts of lots and parcels of land shall pay on account of the
benefits to be derived; and
WHEREAS, the City Council finds that such plans, specifica-
tions and estimates are satisfactory,
NOW, ME—REPO_RE, BE IT RESOLV-P BY =, CITY COUNCIL OF Tim
CITY OF TIGARD as follows:
(a) That the City Cotu,cil deems it expedient and necessary
and hereby declares its intention to construct a sanitary sewer
system for the purpose of providing sewer service to the area
within and without the City of Tigard as described on the attached
sheet marked "Exhibit All and by reference made a part hereof,
(b) That all lands situated within the boundaries described
on the attached "Exhibit All are determined and declared to be a
sewer improvement assessment district, to be known as "5.1;. 72nd
Avenue Improvement District", and it is further declared that each
lot, part of lot and parcel of land within said boundaries will
be especially benefited by said improvements, and that the total
estimated cost of " 1 o for said improvements shall
be assessed in full on an acreageests against all lands within
said district.
(c) That the plans, specifications and estimates with respect
to the sewer improvements as submitted by the Cit-y's engineers be,
and the same are hereby, adopted and ordered to be maintained on
file by the City Recorder for public inspection.
(d) That -Monday, the 27•' day of September, 1971, at the
hour of 8:00 P.DI., at Fowler Jr. High School, 12080 S.W. Dlain
Street in Tigard, Oregon, be, and the same are hereby set as the
time and place for hearing and considering objections or
remonstrances to the proposed improvement by any parties aggrieved
thereby.
Resolution 71-19
(e) That the City Recorder be, and she is hereby, directed
to give notice of said hearing and the above stated matters by
causing to have this resolution published in the Tigard Times,
issues of September 16, 1971 and September 23, 1971.
(f) Within ten days from the date of the first publication
of this resolution, the owners of 66-213% or more in area of the
property within the boundaries described on "Exhibit All hereto
attached, may make and file with the City Recorder a written
objection or remonstrance against the proposed improvement.

EXHIBIT "A"
That portion of land in the Southeast quarter of Section
' 36, Township 1 South, Range 1 West, Willamette Meridian,
Washington County, Oregon, being more particularly described
Cs as follows:
Beginning at a point on the South line of that tract of
land conveyed to George F. Paulsen, Book 520, Page 110, Deed
Records of said County, said point of beginning bearing East
a distance of 100.0 feet from the Southwest corner thereof;
running thence West a distance of 100.0 feet to the said
Southwest corner of the said Paulsen tract of land; thence
continuing West along a Westerly extension of the South line
of the said Paulsen tract of land, across 40 foot wide County
Road No. 245 (S.W. 72nd Avenue), to a point which lies 100.0
feet Westerly of the West right-of-way boundary line of County
{ Road No. 245 (S.W. 72nd Avenue); thence North, parallel to and
100.0 feet Westerly of the said boundary line of County Road
No. 245 (S.W. 72nd Avenue), to a point of intersection with
the Southerly right-of-way boundary line of S.W. Pacific
Highway West (State Primary Highway No. 1 West); thence North-
's easterly along the said boundary line of S.W. Pacific Highway
West (State Primary Highway No. 1 West), crossing 40 foot
wide County Road No. 245 (S.W. 72nd Avenue), to the most
Northerly corner of that tract of land conveyed to Weed Control
f Service, Inc., Book 459, Page 415, Deed Records of said County

East a distance of 114.6 feet, along the Northeasterly line
of the Weed Control Se=-.ice, Inc, tract, to a point on the
Easterly line thereof; thence South 00° 20' East a distance
of 34.8 feet, along the Easterly line :f tract I, to a point
on the Easterly line thereof; thence South 30' 20' East a
distance of 22.0 feet, along the Easterly line of tract I,
to the most Easterly corner thereof, said most Easterly corner
of tract I, also being the most Northerly corner of that tract
of land conveyed to Weed Control Service, Inc., Book 477,
Page 197, Deed Records of said County here-in-after referred
to as tract II; thence South 29° 41' 20" East a distance of
59.76 feet, along the Northeasterly line of tract II, to
the Northeast corner thereof; thence South 00' 26' 40" West
a distance of 250.0 feet to a point on the Easterly line
thereof; thence Southwesterly, along a straight line, to the
point of beginning of this description.
