DECLARING AN INTENTION TO CONSTRUCT CERTAIN STREET IMPROVE—
MENTS WITHIN AN AREA DETERMINED TO BE A STREET IMPROVEMENT ASSESS—
MENT DISTRICT, TO BE KNOWN AS "STREET IMPROVEMENT DISTRICT #21.5
(S.W. 98TH AVENUE)"; DESCRIBING THE PROBABLE TOTAL COST THEREOF;
DEFINING THE BOUNDARIES OF THE DISTRICT TO BE BENEFITED AND
ASSESSED; APPROVING AND ADOPTING PLANS AND SPECIFICATIONS FOR
THE WORK AND ESTIMATES OF THE CITY ENGINEER, AND SETTING PUBLIC
HEARING AND DIRECTING THE GIVING OF NOTICE THEREOF.
WHEREAS, the City Council proposes to improve S.W. 98th
Avenue from the intersection thereof with S.W. Greenburg Road on
the North to a point 630 feet Southerly thereof, by regrading,
widening, paving, curbing, installation of sidewalks, construction
of storm sewers, and installation of lighting facilities; and
WHEREAS, pursuant to Ordinance No. 62-6 the City Council finds
It expedient and necessary to order the improvement of the herein—
alter described lands by regrading, widening, paving, curbing,
Installation of sidewalks, construction of storm sewers, and
Installation of lighting facilities, and pursuant thereto the City
Engineer has submitted to the Council plans, specifications and
estimates for the work to be done and the probable cost thereof
together with a statement of the lots, parts of lots and parcels
of land to be benefited and the apportionment of the total cost
of the improvements which each of said lots, parts of lots and
parcels of land shall be assessed on account of the benefits derived;
and
WHEREAS, the Council finds that said plans, specifications
and estimates are satisfactory.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TIGARD as follows:
(a) That the City Council does hereby deem it expedient and
necessary, and does hereby declare its intention, to improve the
Northerly most 630 feet of S.W. 98th Avenue by regrading, widening,
paving, curbing, installation of sidewalks, construction of storm
sewers, and installation of lighting facilities.
(b) That all lands situated within the boundaries described
on the attached „EXHIBIT A" are determined and declared to be a
street improvement assessment district, to be known as "S.W. 98th
Avenue Improvement District", and it is further declared that each
lot, part of lot and parcel of land within said bc�ndaries will
be especially benefited by said improvements, and chat the total
estimated cost offor said improvements, shall be
assessed in Still, 9'9-fife b..19—, against all lands within said
improvement district.
(c) That the pians, specifications and estimates with respect
to the street improvements as submitted by the City's engineers
- be, and the same are hereby, adopted and ordered to be maintained
on file by the City Recorder for public inspection.
RESOLUTION '7/-7
(d) That Monday, the 14th day of June, 1971, at the hour of
8:00 P.M., at Fowler Jr. High School, 12080 S.W. Main Street in
Tigard, Oregon, be, and the same are hereby set as the time and
place for hearing and considering objections or remonstrances to
the proposed improvement by any parties aggrieved thereby.
C (e) That the City Recorder be, and she is hereby, directed to
give notice by causing to have this resolution published in the
Tigard Times, issues of June 3, 1971 and June 10, 1971.
(f) Within ten days from the date of the first publication
of the notice of this resolution, the owners of 66-2/3% or more
In area of the property within the boundaries described on
^EXHIBIT A^ hereto attached, may make and file with the City
Recorder a written objection or remonstrance against the proposed
Improvement.

ff particularly described as follows:
Beginning at the point of intersection of the Southwesterly
right-of-way boundary line of Greenburg Road with the Westerly
right-of-way boundary line of S.W. 98th Avenue, said point of inter-
section also being the most Easterly Northeast corner of that tract
of land conveyed to H.R. & A.D. Hadley, Book 341, Page 309,
Deed Records of said County; running thence North 62' 37' West,
along the said boundary line of Greenburg Road, a distance of
113.57 feet to the Northeast corner of that tract of land conveyed
to John J. & Gloria S. Adams, Book 495, Page 26, Deed Records of
said County; thence South 20° 38' West, along the Easterly boundary
line of the Adams tract of land, a distance of 218.0 feet to the
Southeast corner thereof; thence South 89' 42' West, along the
Southerly boundary line of the Adams tract of land, a distance of
