CITY OF TIGARD, OREGON
RESOLUTION OF THE CITY COUNCIL CONCERNING VACATION OF DEDICATED,
UNOPENED RIGHT-OF-WAY IN THE NE1/4 of Sec. 11, T2S, R1W, W.M.,
TIGARD, WASHINGTON COUNTY OREGON.
WHEREAS, heretofore ur.'er date of July 15, 1966, Union High
School District #2 Jt., WashinGton County, Oregon (now School Dis-
trict #23J, Washinoton County, Oregon) and George L. Penrose and
Elinore S. Penrose, petitioned the Commissioners of Washington County,
Oregon to approve the proposed vacation of an unopened dedicated
right-of-way as hereinafter described, a copy of said petition so
filed with the Board of County Commissioners being hereto attached
dendted Exhibit "A" and by this reference made a part hereof; and
WHEREAS, said petition was not processed by the County Commis-
sion for the reason that proceedings were then pending for the
annexation of a portion of said lands to the City of Tigard; and
WHEREAS, School District #23J has applied to the City of Tigard
to re-activate the said vacation proceedings; and
WHEREAS, it appears that pursuant to y271.130 O.R.S. the City
Council may initiate vacation prcceedinCs within the City boundaries
and make such vacation without a petition or consent of the property
owners under the terms set forth in said §271.130 ORS,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TIGARD
as follows:
(1) That a hearing is hereby called and set to be held on
Monday, the �2_day of June, 1970 at the hour of 8:00 p.in. at

(2) That the City Recorder be, and she is hereby, authorized
and directed to give notice of said hearing in the following manner:
(a) By publishing written notice once each week
for four (4 consecutive weeks, or five (5) publishings
In all, prior to the date of said hearing, in the form
hereto attached and by this reference made a part hereof,
the first publication to be not less than 28 days be-
fore said Nearing;
(b) By posting a copy of said notice In the form
hereto attached, in three (3) of the most public and
conspicuous places in the City not less than 28 days be-
fore'said hearing;
(c) By posting a copy of the notice in the form
hereto attached at or near each end of the area proposed
' to be vacated, and in at least two (2) conspicuous places
within the area proposed to be vacated, said postings to
�.� be not later than five (5) days after the date of first
publication of the notice under sub-section (a) above.
w• (3) That the City Recorder shall, before publishing or post-
s-.y ing said notices, obtain from School District #23J, Washington
County, Oregon, a sum sufficient to cover the cost of publishing,

posting and other anticipated expenses, estimated to total the sum
Of $100., and the City Recorder shall hold the sum so obtained
until the actual cost has been ascertained, wnen the amount of the
costs shall be paid into the City Treasury and any overplus refunded
to the District.
(4) That the particular portion of the dedicated roadway
to be vacated is described as follows:
As set forth in the attached Petition for
Order of Vacation under Item (4), which by
reference herein is made a part hereof.
