WHEREAS, it is necessary and is the public interest that c
immediate action be taken to provide right-of-way easements for'
the Fanno Creek Sewer Interceptor Line; and
WHEREAS, the following hereinafter named persons have granted
Ztions to the City of Tigard with respect to permanent easements
the installation of said sewer interceptor line within their
respective properties and have further granted temporary construc-
tion rights with respect to installation of said sewer interceptor
line; and
WHEREAS, it is necessary that said options be exercised and
steps taken to obtain easement deeds with respect thereto and for
thepayment of the purchase eonsidt.:ction in each of said options
provided;
NOW,, THEREFORE,
BE IT RESOLVED by the City Council of the City of Tigard,
as follows:
1) That the options described on the attached sheet by
the name of property owner and amount of consideration, whish sheet

exercised on behalf of the City of Tigard.

options, written notice of the exercise thereof by the City Council
and to tender to the owners of the respective properties good and
sufficient easement instruments to convey to the City of Tigard the
easew=ts and rights in each of said options described.
3) That the City Attorney further be, and he is hereby,
authorized and directed to obtain title certificates with respect
to the perpetual rights to be conveyed to the City pursuant to said
options, and the cost of said title assurances, not to exceed $25.

4) That upon the determination by the City Attorney that
good and sufficient title with respect to said easements and rights
of way is vested in the City of Tigard, the purchase consideration
then due with respect to each of said conveyances be, and the same
