AN ORDINANCE AMENDINO" ""° UIPTER 7.44 OF THE TIGARD MUNICIPAL CODE BY
FLIRT RESTRICTING CURFEW HOURS FOR MINORS, BY AMENDING SECTIONS
7.44.020 AND 7.44.030 AND DECLNRING AN EMERGENCY.
WHEREAS, the City Council finds that controlling the presence of
juveniles in public places at nighttime promotes the safety and
welfare of the community; and
WHEREAS, the City Council finds that further restrictiiag curfew hours
will promote such safety and welfare; now therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Tigard Municipal Code Section 7.44.010, Prghibitign

amended to read as follows:
(a) No minor shall be in or upon any street,
highway, parte, alley or other public place between
the hours specified in this Chapter, unless such
minor is:
(1) accompanied by a parent, guardian, or other
person twenty-one years of age or older and.
authorized by this parent or by law to have care and
custody of the minor;
(2) then engaged in a lawful pursuit or
activity which requires such a minor to be present in
such public places during the hours specified in this
Chapter; or
(3) emancipated pursuant to ORS 109.550 through
109.565.
SECTION 2: Tigard Municipal Code Section 7.44.020, Prahibit an

(a) No parent, guardiLn or person having the care
and custody of a minor under the age of eighteen
years shall allow such minor to be in or upon any
street, highway, park, alley or other public place
between the hours specified in Section 7.44.025,
except as otherwise provided in that Section.
SECTION 3: Tigard Municipal Code Chapter 7.44 is amended by
adding Section 7.44.025, 5I'TIM Hours For Minors, to
read as follows.

(a) For minors under the age of fourteen (14) years,
the curfew is between 9:15 p.m. and 6 a.m. of the
fallowing morning, except on any day immediately
preceding a day for whf.ch no public school is
scheduled in the City, tha curfew is between 10:15
p.m. and 6 a.m. of the following morning.
(b) For minors fourteen (14) years of age or older,
the curfew is between 10:15 p.m. and 6 a.m. of the
followir:g morning, except on any day immediately
preceding a day for which no public school is
scheduled in the City, the curfew is between 12
midnight and 6 a.m. of the following morning.
SECTION 4: Tigard Municipal Code Section 7.44.030, Custody of
Minors Violating Curfew, is hereby amended to read as
follows:
(a) Any minor who violates a provision of this
Chapter may be taken into custody as provided in ORS
4190.080, 4190.0$5 and 419C.088 and may be subjected
to further proceedings as provided in ORS Chapter
4190.
SECTION 5 Because prompt implementation of this ordinance is
necessary for the peace, health, and safety of the
people of the City of Tigard, an emergency is
declared to exist, and this ordinance is effective
upon its passage by the Council.
