ORDINANCE NO. 92-33
AN ORDINANCE TO CLARIFY AND MODIFY PARK RESERVATION PROCEDURES AND
REGULATIONS AND DECLARING AN EMERGENCY.
WHEREAS, the City Council, pursuant to Ordinance No. .7.1=11.,., declared the
intent to exercise general supervision, management and control of all
public parks and associated facilities and equipment, and to prescribe
the necessary rules and regulations necessary to protect and preserve
such facilities for the convenient and safe use by the public; and,
WHEREAS, the City of Tigard has purchased and developed a new major city
park known as Summerlake Park; and
WHEREAS, the Municipal Code has not been reviewed, revised or undated
since May, 1956.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: That Section 7.52.080 and Chapter 9.04 of the Tigard
�tunicipa,l Code, relating to Parks, be amended and supplemented as
illustrated in Exhibit A. Passages in brackets and highlighted shall be
deleted from the city code and passages underlined shall be added to the
city code.
SECTION 22 Inasmuch as it is necessary that this ordinance be adopted
in conjunction with the attached resolution 92-_511_ and in order to
ensure that reasonable safeguards for health, safety, and welfare of the
public are maintained, an emergency 'is hereby declared to exist, and
this ordinance shall become effective January 1, 1992 upon passage and
approval by the Council.

(4) Not-forr_profit league field users, including, but not
limited to School District 233 Turd Little League and Tigard I,
Soccer Association shall reserve fields through the Tigard Field
Use Committee.
(5) Total reservations at any one time shall not exceed five
hundred people.
,(6) City of Tigard sponsored activities shall have fi st
priority for the use of narks and shall reserve space for their
programs and activities first. The second priority for park
scheduling is for the members of the Tigard Field Use Committee.
All other nark users will be scheduled 'on a f irst come f irst serve
basis-vear around un to one year in advance°
(7) Park reservations allow for exclusive use of those areas

block or inhibit in any way access to other parts of or facilities
in the park.
(8) Additional costs incurred by the City because of abuse or
excessive clean-uta and/or repair as determined by the Public Works
Depa. tment shall be charged to the reserving group creating the =
added cost. - All such excessive clean-up andLor repair shall be
documented by the Public Works crew, including photocLraphs, and
filed with the City Administrator or designee.

person in charge after the activity and upon computation of the

application.

(9) Use of Tigard cites parks for profit making activities by
an individual or araanization not defined as a non-profit
oraanization by the State of Oregon is regulated by Section
7 52 080 of this Code._
(b) Fundraising activities by State of Oregon designated nan-
rp ofit organizations or individuals must be apAraved by the_City
Administrator or designee.
9.;;4,J4v Refund of fees and chance in reservation. (a) Any
group seeking a refund because of inability to use facilities as
requested shall submit a written statement of refund request, to
include:
(1) Name of group, address and telephone;
(2) Name, address and phone number of persons/group to whom
refund is to be paid;
(3) The reason for seeking the'fund and the amoiant requested;

(b) All refund requests must be approved by the city
administrator or designee.
(c) Noe funds shall be made to any individual or organization
based on weather conditions.
(d) Requests for refunds must be made two weeks prior to the
reserved. date.
(e) The City reserves the right to cancel any scheduled usage
of the park at any time. Every effort shall be made to find' an
acceptable alternative date or location. A full refund including
the application fee shall be issued when the city cancels a
reservation.

A RESOLUTION SETTIM FEES FOR PARK RESERVATIONS; REPEALS RESOLUTION Ido. 87-155;
SETS AN EFFO TIVE DATE.
WHEREAS. Chapter 9.04.010 of the Tigard Municipal Code sets forth the purpose
of Parks rules and regulations including the facilitation of maximum use of
public facilities, and to provide access to such facilities at minimal costs,
tt but where exclusive was takes place or special handling is required to assess
appropriate fees; and
WHEREAS, Chapter 3,32 of the Tigard Municipal Code grants the City Council the
authority to set fees and charges by resolution; and
WHERF.AS, Park reservation fees were last updated effective January 1, 1988;
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The following fees shall be charged:

Section 2: Tigard area non-profit organizations shall pay one half of
the Tigard based hourly rental rate provided the following criteria are
met:
i (A.) The organization must follow established procedures for making
reservations for the use of the
facility;
t11t the time the reservation is made for use of the facility by
the organization, documentation of non-profit stratus must be provided;
(C) The organization shall meet the definition of Tigard-based
nonprofit organization, as set forth in Section 18.26.030 of the Tigard
Municipal Code.
