ORDINANCE NO. 92- 3a
AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE CHAPTER 2.28 BY
AMENDING SECTIONS 2.28.030 RELATING TO THE EQUIPMENT AND UNIFORM
REQUIREMENTS FOR POLICE RESERVE; AND 2.28.100 RELATING TO
COMPENSATION FOR POLICE RESERVE OFFICERS
WHEREAS, the City Council wishes to provide and maintain uniforms
for the Police Reserve; and
WHEREAS, the City Council wishes to guarantee police officer base
rate of pay to reserve officers called to duty under an emergency;
and
WHEREAS, reserve officers are often called upon to perform duties
falling outside their regular duties, such as providing security
for athletic events and directing traffic for large gatherings; and
WHEREAS, The City Council wishes to allow the Police Department to
contract out the police reserve officers for such outside jobs at
the base police officer rate; and
WHEREAS, ORS 656.031 allows the City to elect to have municipal
volunteer personnel considered as subject workers for purposes of
Workers' Compensation; now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 2.28.030 of the Tigard Municipal Code is
i amended to read as follows:
2.28.030 EEgUipment and uniform requirements.
The City shall furnish and maintain uniforms for
reserve officers. All reserves will be required to
purchase their own protection vest, weapon, duty
belt and equipment. The protection vest will be
replaced when needed, as determined by the chief of
police, at city expense.
SECTION 2: Section 2.28.100 of the Tigard Municipal Code is
amended to read as follows:
2.28.100 Compensation provisions and Contract
Services.
A. Members of the police reserve shall receive no
compensation for their membership therein or while
on duty unless the chief of apolice declares an

emergency and then they would be paid based on
police officer rate.
H. However, section (A) above shall not prohibit
the City from contracting with public or private
entities for services provided by reserve police
officers including, but not limited to, providing
security and directing traffic, and shall charge
base police officer rate for such services.
C. while on duty as a reserve officer, each
individual will, be covered by the city workers"
compensation insurance for work related injuries
and under the city's liability policy as long as
they are acting within the scope and responsibility
of their position, unless prohibited by a separate
agreement.
SECTION 3: This ordinance shall be effective 30 days after its
passage by the Council, approval by the Mayor, and
