ORDINANCE NO. 92-
AN ORDINANCE APPROVING AN AMENDMENT TO THE TIGARD COMPREHENSIVE PLAN
TRANjPORTATION MAP BY CHANGING DESIGNATION OF THE SEGMENT OF SCHOLLS
FERRY ROAD BET'W'EEN ITS INTERSECTIONS WITH OLD SCHOLLS FERRY ROAD FROM
ARTERIAL TO MAJOR COLLECTOR (CPA 92-0004) AND APPROVING AN AMENDMENT TO
TIGARD'S CO_ INITY DEVELOPMENT CODE SECTION 18.96.020 TO REFLECT THE ,
CHANGE IN DESIGNATION OF THE SCHOLLS FERRY ROAD SEGMENT (2OA 92-0002) .
WHEREAS, the proposal to amend the Comprehensive Plan Transportation Map
by changing the designation of Suholls Ferry Road between its
intersections with Old Scholls Ferry Road would make Tigard's
designation of this segment of road consistent with Washington County
and Beaverton; and
WHEREAS, in order to be consistent with road C.asi a}9nnr- it is
necessary to amend Community Development Code Section 18.96.020; and
WHEREAS, NPO #7 has discussed this proposal and recommends approval; and
WHEREAS, the Planning Commission conducted a public hearing for the CPA
92-0004 and ZOA 92-0002 proposals at its regular meeting on July 20,
1992 and recommends approval.
NOW THEREFORE, TI3E CITY OF `IIGARD ORDAINS AS FOLLOWS:
SECTION 1: The proposal is consistent with all relevant criteria as
noted below:
The relevant criteria in this case are Statewide Planning Goals 1, 2,
12, and City of Tigard Comprehensive Plan policies 1.1.1 a. , 2.1.1,
8.1.2, and applicable Community Development Code sections relatedto
legislative plan amendments.
The proposal is consistent with the applicable Statewide Goals
based on the following findings;

1. Goal 1, Citizen Involvement, is met because the City has an
adopted citizen involvement program which includes review
of land use applications by neighborhood planning
organizations. In addition, this proposal will be reviewed
in public hearings by the Planning Commission and by the
City Council for which proper notification is publicized.
2. Goal 2, Land Use Planning, is met because the City has
applied all relevant Statewide Planning Goals, City
Comprehensive Plan policies, and Community Development Code
requirements in the review of this proposal.
3. Goal 12, Transportation, is met because the City has
adopted policies, related to improving the transportation
network and continuing coordination of transportation
improvements with other involved agencies.

The proposal is consistent with the City's acknowledged
d" Comprehensive Plan based on the following findings:
1. Policy 1.1.1 a. is satisfied because the change in
designation of Scholls Ferry road between its
intersections with Old Scholls Ferry Road conforms
to changed circumstances resulting from the Stene
and County redesignation of the roads and therefore
will not affect compliance of the city s
acknowledged Plan with the Statewide Goals.
2. Policy 2.1.1 is satisfied because Neighborhood
Planning Organization #7 have been notified of the
nearing and have been given the opportunity to
comment on the proposal. In addition, there will
be a minimum of two public hearings which will be
posted at City Hall and advertised in a local
newspaper prior to each hearing.
3. Policy 8.1.2 is satisfied because of the proposed
amendments to the Comprehensive Plan Transportation
Map are , for the purpose of establishing a
consistent designation with Washington County. In
addition, other agencies and jurisdictions,
(` including Washington County, Metro and Beaverton,'
`- have been notified and given the opportunity to
comment on the proposal.
SECTION 2: The City Council hereby amends the Comprehensive Plan
Transportation Map by changing the designation of Scholls
Ferry Road between its intersections with old Scholls
Ferry Road from arterial to major` collector as shown in
Exhibit "A."
SECTION -3: The City Council hereby amends Community Development Code
Section 18.96.020 by adding sections referring to Scholls
Ferry Road designation as shown by bold faced and
f underlined passages in Exhibit "B."
SECTION 4: This ordinance shall be effective 30 daysafterits
{ passage by the Council, approval by the Mayor, and
posting by the City Recorder.

18.96.010 Purpose
A. The purpose of this chapter is to permit or afford better light,
air and vision clearance on more heavily traveled streets and on
streets of substandard width, to make the location of structures
compatible with the need for the eventual widening of streets by
providing for additional yard setback distances, to ensure there is
adequate distance between buildings on the site and to provide
standards for projections into yard areas.
18.96.020 Additional Setback from Centerline Required
A. To ensure improved light, air, and sight distance and to protect
- the public health, safety,r and welfare, structures in any zoning
district which abut certain arterial and collector streets shall be
set back a minimum distance from the centerline of the street.
B. where the street is not improved, the measurement shall be made at
right angles from the centerline or general extension of the street
right-of-way:

C. The minimum yard requirement shall be increased in the event
a yard abuts a street having a right-of-way width less than
required by its functional classification on the City's
transportation plan map and, in such case, the setback shall
be not less than the setback required by the zone plus one-
half of the projected road width as shown on the
transportation map.
D. The minimum distance from the wall of any structure to the
centerline of an abutting street, however, shall not be less
than 25 feet plus the yard required by the zone. This
provision shall not apply to rights-of-way of 50 feet or

18 96.030 Distance Between Multiple-Family Residential Structure and
Other
Structures on the Site
A. To provide privacy, light, air, and access to the multiple and
attached residential dwellings within a development, the
following separations shall apply:
1. Buildings with windowed walls facing buildings with
windowed walls shall have a 25 feet separation;
2. Buildings with windowed walls facing buildings with a
blank wall shall have a 15 feet separation;
3. Buildings with opposing blank walls shall have a 10 feet
separation;
4. Building separation shall also apply to buildings having
projections such as balconies, bay windows, and room
l projections; and

5. Buildings with courtyards to maintain separation of
opposing walls as listed in 1, 2, and 3 above,for walls
in separate buildings.
B. Where buildings exceed a horizontal dimension of 60 feet or
exceed 30 feet in height, the minimum wall separation shall be
one foot for each 15 feet of building length over 50 feet and
two feet for each 10 feet of building height over 30 feet.
C. Driveways, parking lots, and common or public walkways shall
maintain the following separation for dwelling units within

18.96.080 Lot Area for Flag Lots
A. The lot area for a flag lot stall comply with the lot area

site area exclusive of any accessway (see figure following) .

18.96.090 Front Yard Determination
A. The owner or developer of a flag lot may determine the
location of the front yard, provided no side yard setback area
is less than 10 feet and provided the requirements of Section
18.98.030, "Building Heights and Flag Lots, are satisfied.
