AN ORDINANCE AMENDING ORDINANCE 88--26, BY CLARIFYING -THE: EF F EC:'I'1VE DATE WHEN 11
IS UNLAWF=UL_ TO TAMPER w1TH ANIMALS USED FOR LAW ENFORCEMENT PURPOSES AND
DECLARING AN EMERGENCY.
WHEREAS, the 'Tigard City Council adopted Ordinance 88--26 un September 26, 1988,
making it unlawful to tamper with animals used for law enforcement purposes; and
WHEREAS, contained in that or•dini•;nce was a scr•ibners error, which made it: unclear
whether thL, effective data. would be immediately uppassage, or, effective 30 days
after passage; and
WHEREAS, the Police have experienced situations where the dogs, while acting in
the line of (iuty, have been called while chasing a suspect and while tracking
evidence, and the Police depend on the dogs for law enforcement purposes.
THE CITY OF TIGARD ORDAINS AS FOI...LOWS:
Section 1. Ordinance 88--26 shall be amended by deleting the second paragraph in
Section 2, as noted below.
[This ordinance shall be effective 30 days after its passage by the
Council, approval by the Mayor, and costing by the City Recorder.]
The Tigard City Council hereby clarifies its intent that: Ordinance No.
88--26 was effective immediately upon its passage September 26, 1988.
Section 2. -This Ordinance is necessary to protect the yeneral welfare and safety
and the people of the City of Tigard because the safety and welfare of
the Police Service Dogs is required for an efficient operation of the
Police Department, therefore, an emergency is hereby declared to exist
and this Ordinance shall become effective immediately upon passage and
approval by the City Council.
