AN ORDINANCE CREATING THE SW 13RTH AVEiMU i iii^.AL TMPROVE'MENT DISTRICT, ORDERING
'THE CONSTRUCTION OF STREET IMPROVEMENTS IN ACCORDANCE WITH 'THE PRELIMINARY
ENGINEER'S REPORT, DIRECTING BID PROPOSALS BE REQUESTED, SETTING FORTH THE
METHOD OF ASSESSMENT AND METHOD OF FINANCING,
The City Council Finds:
1. On August 11, 1986, the City Council initiated consideration of a local
z
improvement district for street improvements on SW 135th Avenue.
2. The Community Development Director, submitted a report to the Council
recommending the district be formed. The recommendation was based on a !
Preliminary Evaluation Report and the Council's adopted policy regarding

3. The Council, by Resolution No. 87-101, stated its intention to form the
district, to make the improvements and to hold a public hearing to receive
remonstrances,
4. At least ten days prior to the hearing, individual notice was mailed by
first class mail to all property owners within the local improvement
district and notice was published in the Tigard Times.

5. The hearing was held on August 31, 1987. At the hearing, the Council
received remonstrances from the owners of 24 properties within the
district. #
6. There are 436 benefited properties, and there were remonstrances from the ;
owners of 24 properties, representing 35.2% of the land area. The Charter
provides that a local improvement district cannot be formed if the
property owners of 66-2/3% of the land area within the district
remonstrate. The remonstrances did not approach this number, t;
7. The Council adopted the Preliminary Engineer's Report by Resolution No. }
87-28, and amended the Report by Resolution No. 87-101. Further revisions
have been made through the hearings process.

8. The City has proceeded in accordance with state statutes, its charter and
ordinances.
THE CITY OF TIGARD ORDAINS AS FOLLOWS: j
Sectional: The SW 135th Avenue Local Improvement District is created. The
legal description is set forth in attached Exhibit A.

Section 2.: The improvements shall be made in accordance with the
preliminary engineer' s report as amended through the hearings
process as set forth in the report adopted by Resolution No.
87-28 and amended by Resolution No. 87-101. Said report is
further amended by adoption of the "Addendum to Preliminary
Engineering Report" attached hereto as Exhibit B.
Section 3: The benefited properties include all properties described in
Exhibit A exclusive of public improvements.
Section 4: The City Engineer is directed to invite bid proposals for the
construction of the improvements in the manner prescribed by
the Purchasing Rules.
Section_5: The total estimated cost for the proposed improvements, not
including right-of-way acquisition costs, is $1,124,451.00,
The benefitted properties shall be assessed for all costs of
design and construction on the basis of traffic generation
potential., as described in the preliminary engineer's report,
to arrive at a fair, apportionment of the costs among the
specially benefitted properties. Existing valid preliminary
plats, approved by and binding on the City of Tigard, shall be
recognized in calculating the traffic generation Potenti—ml. -
The traffic: generation potential shall be based or: the zoning �
in existence on July 13, 1987.
Section 6: Duo to the potential future alternate access via proposed
Murray Boulevard extension, properties in the 7area described in
attached Exhibit C are considered to have a reduced benefit and
�+ shall be assessed at 50% of the traffic generation potential of
similar lots elsewhere in the district.
Section 7: Sufficient righi-Of-way she!) kw acquired where necessary to
meet the minimum City standards for collector streets (30 feet
each side of the center.lina of the new roadway) . Any and all
costs of right-of-way acquisition, including legal and
appraisal fees, shall be .assessed on a front-footage basis, as
measured along the edge of the new right--of--way. The
acquisition costs will be assessed only against those
properties along the new right-of-way which did riot dedicate
all necessary right-of-way to the City at no cost.
Section 8: The improvements are of a character described in ARS 223.205
and the improvements qualify for financirig by general
obligation improvement; warrants pursuant to ORS 287.502 -
287.510.
Section 9 General obligation improvement warrants are authorized to be
issued in the aggregate amount of $1,200,000. The interest
rate shall be at the lowest interest rate the city can borrow
on the date of the sale.

Section 10: The Mayor and Finance Director, ar-e authorized to execute the
general obligation impr-ovement war•r•ants on behalf of the City.
Section 11: This ordinance shall become effective on or, after- the 31st day
after- its Passage by the Council.

The purpose of this Addendum is to describe and document the revised project scope and
pertinent data for the proposed 135th Avenue LID.

Several alternatives to the LID originally presented in the February 6, 1987 report have
been evaluated, with the selected alternative identified as B-2. Material presented in this
V Addendum is limited to Alternative B-2. Portions of the original report including Design
Requirements and Preliminary Design for 135th °;,•renue remain unchanged except as
described herein.

Improvements to be constructed under the LID are limited to 135th
Avenue. Murray Boulevard improvements are not included. Construction
improvements for 135th Avenue will begin at the south line of LID Lot 389
and run north to Scholls Ferry Road, a distance of approximately 3500
lineal feet. Construction will include a transition to match the existing
135th Avenue improvements near the south line of Lot 389 if Murray
Boulevard has not been constructed prior to 135th Avenue LID completion.
Improvements will include reconstruction of 135th Avenue to Minor
Collector standards including:
* Right-of-way width is a minimum of 60 feet
* Street width 40 feet between curbs
Curb and gutter plus five (5) foot sidewalks on each side ---

Existing overhead power and telephone lines will be

E_e * The Summer Creek crossing will include construction of a low
road profile culvert crossing that will be flooded during a 100-

The design will meet FEMA flood plain regulations for no increase in
flood plain elevation as a result of the improvements.
Prior to final design a bridge alternative for the Summer Creek
crossing will be evaluated and presented to the City Council for
review.
