AN ORDINANCE: TO AMEND SECTION 18. 114.145 OF THE COMMUNITY DEVELOPMENT CODE -
SIGN CODE EXCEPTION CRrTt=RIA (ZOA 87-02) .
WHEREAS, the City of Tigard finds it necessary to revise its Community
Development Code periodically to improve the operation and implementation of
the Code; and
WHEREAS, the planning staff made recommendation of findings to the City of
Tigard Planning Commission on May 20, 1987; and
WHEREAS, the Planning Commission voted to recommend approval of ZOA 87--02 at
this same meeting; and
WHERE2S, the Tigard City Council held a public hearing on the proposal changes

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Community Development Code shall be amended as shown in
Exhibit "A". Language to be deleted is shown in [BRACKETS].

Section 2: That this Ordinance shall be effective on and after the 31st
day after its passage by the Council and approval by the Mayor.

18.114.145 Approval Criteria for Exceptions to Sign Code
(a) The Planning Commission shall approve, approve with conditions,
or deny a request for an exception to the Sign Code based on
findings that at hast one of the following criteria are
satisfied:
(1) The proposed Sign Code Exception is necessary because a
conforming building or sign on an adjacent property would
limit the view of a sign erected on the site in conformance
with the Sign Code standards;
(2) The proposed exception to the height limits in the Sign Code
is necessary to make the sign visible from the the street
because of the topography of the site;
[(3) There is an access drive which services the business or
service from a street other than the street which it is
heated on.l
_C3I A freestanding sign to be located on a secondary access
drive that serves the subject property from a street other
than the street to which the business is oriented.
(4) Up to an additional 25% of sign area or height maybe
permitted to adequately identify the business when it is
determined that the increase will not deter from the Purpose
of this Chapter. This increase should be judged according
to specific ' -identification needs and circumstanceswhich
additional area to make the sign sufficiently
legible. The increase(s) shall not conflict with any other
non-dimensional standards or restrictions of this Chapter.
The proposed sign is consistent with the criteria set forth
in Section 18.114.130(g) of this Chapter.
_Ub In addition to the criteria in subsection (a) above, the
Commission shall review all of the existing or proposed signage
for the development and its relationship to the intent and
purpose of this Chapter. As a condition of approval, the
Commission may require:
Removal of alteration of non-conforming signs to achieve
compliance with the standards contained in this Chapter; and
Removal or alteration of conforming signs-_ in order to
establish a consistent sign design throughout the
development.
3) Application for sign permits for signs erected without
permits or removal of such illegal signs.

construction of the private street.

Commissioners Newton and Moen favored public streets. Further discussion
followed regarding the streets and dedication of the open spaces.
R Commissioner Fvre moved and Commissioner Owens seconded to approve
PD/87-02, ZC 87-01, and SL 87-04 as proposed based on staff findings and
recommendations. Also, staff is to prepare the final order and President
Moen is to sign the final order. Motion carried by majority of
Commissioners present. Commissioners Moen and Newton voting no.
Commissioner Vanderwood abstained.
5.3 ZONE ORDINANCE AMENDMENT ZOA 87-02 SECTION 18.114.145
Amendments to the Sign Code Exception criteria contained in the Tigard
Municipal Code, Section 18.114.145.
Senior Planner reviewed the changes explaining that these Amendments were
being proposed as a result of difficulties in approving previous sign
code exceptions that warranted approval. _
o Discussion followed regarding the language for criteria 18.114.145(a)(4)
and 18.114.145(b)(2). Consensus was the language should be expanded,
possibly to list circumstances under section (a)(4) and including
criteria for removal of conforming sign under section (b)(2).

* Commissioner Moen moved and Commissioner Vanderwood seconded to forward
ZOA 87-02 to City Council with a recommendation of approval after
ezpanding on section 18.114.145(x)(4) and including criteria for section
18.114.145(b)(2). notion carried unanimously by Commissioners present.
o The Commission requested that staff provide the Commission with a copy of
the proposal prior to submittal to City Council.
5.4 ZONR ORDINANCE AMENDMENT ZOA 87-01 FEMA CHANGES/SENSITIVE LANDS
Request by the City of Tigard to amend the following sections of the
Community Development Code as they pertain to Sensitive Lands and Federal
Emergency Management Agency's (FEMA) National Flood Insurance Program
requirements: 18.84, 18.94.030, 18.94.040, and 18.160.020. -
Senior Planner Liden explained that staff originally was proposing other
changes for the Sensitive Lands section of the Code, however, because of
FEMA=s deadline of June 15, staff had gone through the report and marked
with an asterisk on all items which are required by FE-Me
