ORDINANCE NO. 87-3(P
AN ORDINANCE OF THE TIGARD CITY COUNCIL TO AMEND TIGARD MUNICIPAL
CODE SECTION 2 . 16.030 AND SETTING AN EFFECTIVE DATE.
WHEREAS, Tigard Municipal Code Section 2. 16.030 creates the
office of pro tempore municipal judge of the municipal
court of the City of Tigard; and
WHEREAS, Said code provision currently authorizes a protempore
municipal judge to act only when the municipal judge is
unable to perform his duties by reason of absence from
the city, illness, vacation or disqualification as
provided by ORS Section 221.348; and
WHEREAS, The annexation of Washington Square and South Metzger
are anticipated to increase the volume of criminal cases
charged into Tigard Municipal Court; and
WHEREAS, Modification of Tigard Municipal Code Section 2. 16.030
is necessary to assure that the coux,t has a judge or
judges sufficiently available to meet this anticipated
increase in volume in the absence of the municipal
judge.
NOW, THEREFORE
THE CITY OF TIGARD ORDAINS AS FOLLOWS:

amended to read as appears as Exhibit "A" , which is attached
hereto and which is hereby adopted.
Section 2. This ordinance shall be effective on and after the
30th day after it is enacted by the Council and approved by the
Mayor.

EXHIBIT "A"
2.16.030 Pro tempore municipal judge The office of pro tempore municipal
judge of the municipal court for the city is created. One or more pro
tempore municipal judges may be incumbent at any given time. The holder(s)
of the office shall be subject to appointment and removal in like manner as
herein provided with respect to the municipal judge. A pro tempore municipal
judge shall act only when the municipal judge is unable to perform his duties
by the reason of absence from the city, illness, vacation, disqualification
as provided by ORS 8221.347, or as specifically determined by the court
administrator, and in such circumstances the court personnel shall assign one
of the pro tempore judges to serve in lieu of the municipal judge.
The pro tempore municipal judge shall be compensated in the sacra rnanner
as the municipal judge (Ord, 87- 3Co , 1987; Ord. 85-26 S1(part), 1985).
