ORDINANCE NO. 851-
AR! ORDINANCE AMENDING SECTIONS 18,56.050 AND 18.58.050 OF 'THE COMMUNITY
OEVELOPMENT CODE AND DECLARING AN EMERGENCY. (7.OA 4-85)
WHEREAS, the City of Tigard finds it necessary to revise its Community
Development Code periodically to improve the operation and implementation of
the Code; and
WHEREAS, the Tigard City Council has reviewed the Community Development Code
and has adopted the same; and
WHEREAS, the City of Tigard Planning Commission held public hearings on the
proposed changes on August 6, 1985; and
WHEREAS, the Tigard City Council held a public hearing on the proposed changes
on September 9, 1985.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Sections 18.56.050(3) and 18.58.050(3) of the Community
j Development Code shall be repealed.
Section 2 The Community Development Code shall be amended with new
Sections 18.56.050(3) and 18.58,050(3) as shown on Exhibit: "A"
Section 3: In order that the Community Development Code may improve the
operation and implementation of the code an+. to protect the
public health, safety and welfare, an emergency is hereby
declared to exist and this Ordinance shall become effective upon
its passage by the Council and approval by the Mayor.

EXHIBIT "A"
(3) The minimum setback requirements are as follows:
(A) For multiple family dwellings, the front yard setback shall be a
minimum of 20 feet. For single family dwellings, the front yard
shall be a minimum of 15 feet.
(9) For multiple family dwelling units on corner and through lots,
the minimum setback for each side facing a street shall be
20 feet, however, the provisions of Chapter 18.102 (!USUAL
CLEARANCE) must be satisfied. For single family dwelling units,
the minimum setback fcr each side facing a street shall be 10
feet, however, the provisions of Chapter 18.102 must be
satisfied.
(C) For multiple family dwellings, the side yard setback shall be a
minimum of 10 feet. For single family dwellings, the side yard
setback shall be 5 feet except this shall not apply to attached
units on the lot line on which the units are attached.
(0) For multiple family dwellings, the rear yard setback shall be a
minimum of 20 feet. For single family dwellings, the rear yard
shall be a minimum of 15 feet.
(E) Where the side yard or rear yarn of attached, multiple family or
single family dwellings abut a more restrictive zoning district,
such setbacks shall not be less than 30 feel:.
(F) The distance between the property line and the front of the
garage shall be a minimum of 20 feet.
