ORDINANCE NO. 85--
AN ORDINANCE AMENDING SECTIONS 18.68.030, 18.70.030, 18.72.030, AND 18.100.090
OF THE TIGARD COMMUNITY DEVELOPMENT CODE; AND DECLARING AN EMERGENCY. (ZOA
2-55)
WHEREAS, the Community Development Code allows for certain residential uses
within the I-P, I-L, and I-H zones; and
WHEREAS, it has been recommended by the Tigard planning Commission that these
uses be listed within the "permitted uses" section of each industrial zone; and
WHEREAS, the City's policy regarding fence height is unclear;
THE CITY OF TIGARD ORDAINS. AS FOLLOWS:
Sections 1 Sections 18.68.030, 18.70.030, and 18.72.030 of the Commur:ity
Development Code shall be amended by adding the following
subsection:
(4) A single--family detached units or a single
manufactured/mobile home provided that the uses are limited
to the following:
(A) A dwelling for a caretaker or superintendent which is
located on the same site with the permitted 'industrial
u•:_ and is occupied exclusively by a caretaker or
superintendent of the industrial uae and family; or
(8) A dwelling for, a kennel owner or operator which is
located on the same site with the kennel and is
occupied exclusively by the owner or operator of the
kennel and family.
Section I Section 100.090 of the Community Development Code shall be
amended as set forth below. Items to be added are underlined
and items to be deleted are shown in [brackets].
18.100.090 Setbac°-:^ for fences or walls. (a) No fence or wall
shall be constructed which exceeds the standards in subsection
(b) of this section except when the [hearings officer] rp oval
authority, as a condition of approval, allows that a fence or
wall be constructed to a height greater than otherwise permitted
by this section in order to mitigate against potential adverse
effects.

(1) May not exceed three feet in height in a required
front yard or six feet on a corner side yard or eight
f• (8) feet in all other, locations and in all cases shall
meet vision clearance area requirements (Chapter
18.102);
(2) Are permitted outright in side yard or rear yards to a
height of six feet;
(3) Located in a side yard and which (exceed] are between
six and eight Beet in height shall be subject to
building permit approval;
(4) Located in the front yard or corner side yard and
which exceed the height limitation shall comply with
the setback requirements for structures set forth in
the 7plicable zone;
(5) Located within a corner side shall be no closer than
two feet from the property line, and shall satisfy
visual clearance requirements. (Ord. 83--5& Exhibit A
