AN ORDINANCE ADOPTING FINDINGS AND UPHOLDING THE PLANNING COMMISSION'S
APPROVAL OF A COMPREHENSIVE PLAN AMENDMENT (CPA 21--84) AND DECLARING AN
EMERGENCY.
WHEREAS, the subject property contains 3.73 acres and is within the City
of Tigard; and
WHEREAS, Pacific Western Bank, property owner, has requested a
Comprehensive Plan Amendment From Heavy Industrial to Commercial professional;
and
WHEREAS, this application complies with Section 18,22.030 and 18.22.040 of
the Tigard Co�fi-tunity Development Code which identifies standards and
procedures for Comprehensive Plan Amendments and Zone Changes.
A. This application will not adversely aFfect the health, safety and
welfare of the Community.
B. This application is in compliance with LCDC Goals 1, 2 and 9.
C, There is evidence that the City errored in limiting the southern
portion of the property to industrial use with Heavy Industrial Plan
designation while designating the remainder of the property as
Commercial Professional.
WHEREAS, this site complies with the locational criteria for the
Commercial Professional Plan designation as set forth below:
1. Spacing and location
a. The Comprehensive Plan Map fixes exact boundaries of the
Commerrial Professional Area.
b, Th site is not adjacent to any residential districts.
2. Access
a. Proper access to SW 72nd Avenue is available.
3. Site Characteristics
4. The site is an adequate site for the proposed use.
Vie. The site is highly visible.
4. Impact Assessment
a. There are no adjacent non--commercial uses.
b. The significant slope on the site will be taken into consideration
in the design of the site.
c. It will be possible to screen lights and buffer noise and
activities from adjoining non-residential uses.

THE CITY OF TTGARD ORDAINS AS FOLLOWS;
Section 1. The City Council upholds the Planning Commission's approval of the
Comprehensive plan land Use Map Amendment as proposed and set
north in attached Exhibit "A" (Map) and "B" (Legal Description).
Section 2. Inasmuch as it is necessary to revise the City's Comprehensive
Plan Maps to allow development in a timely manner, an emergency is
declared to exist and this ordinance shall become effective upon
its Passage by Council and approval by the Mayor.
