AN ORDINANCE OF THE TIGARD CITY COUNCIL AMENDING SECTION 15.04.030 OF THE
RRL ^,TWIG_ TO FEES CHARCFp FOR STREET AND ALLEY EXCAVATION

PERMITS, CHANGING THE METHOD BY WHICH FEES ARE ESTABLISHED AND DECLARING THE
EFFECTIVE DATE AS NOVEMBER 1, 1984.
WHEREAS, Chapter 3.32 City Fees and Charges of the Tigard Municipal Code
grants the Tigard City Council the authority to set rates for service fees and
charges by resolution; and
WHEREAS, the administration and enforcement of the fees and charges activity
is simplified by establishing rates by resolution; and
WHEREAS, Chapter 3.32 of the Tigard Municipal Code establishes a set of
policies relating to the calculation of a fee rate; and
WHEREAS, Section 15.04.030 sets the fee rate as part of -the permit application
process; and
WHEREAS, November 1, 1984 is the date when all fees and charges which are
changing are scheduled to take effect.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1. "Section 15.04.030 Permit — Application" is amended as follows,
with bracketed items ((J) deleted and replaced with underlined
items (�):
"15.04.030 Permit—Application. (a) At the time of application
for permit for a limited time and for a specific cut or break in a
street or- alley, the applicant shall specify his name and address,
the date of application, the name of the street or alley to be cut
or tunneled under; the nature of the street surface or of pavement
involved; the purpose of the work; the size and nature of the cut
or excavation; the number of days required to complete the work;
and shall execute an agreement to deposit such securities as
required by the city, to comply with the provisions of this
chapter and with the specifications of the city pertaining to the
conduct of the work, to save the city and its employees harmless
against any injury or damage which may result from the actions of
the applicant, and to file a report of the work done within
forty-eight hours of its completion. Application for each permit
to be it^W.ed for a limited time and for a specific cut or break in
the street or alley shall be accompanied by a fee [of ;our percent
of the estimated construction cost, but not less than a
four-dollar minimum charge.2 set by City Council according to
Chapter 3.32 City Fees and Cha:cces in the Tigard Municipal Cade.

"(b) The application for an annual permit shall be in fo;^m as
prescribed by the city and shall specify the name and address of the
applicant, as required by the city, to comply with the provisions of
this chapter, an agreement to save the city and its employees
harmless against any injury or damage as a result of the actions of
the applicant, and to file a report of all work done under the

or alley has been made. Application for an annual permit shall be
accompanied by a fee [of one hundred dollars.] set by_City Council
according to Chapter 3.32 Cid Fees and Charges in the Tigard
Municipal Code."
Section 2. Effective Date. This ordinance shall be effective on and after
the 1st day of November, 1984.
