AN ORDINANCE AMENDING CHAPTER 18.120 SITE DEVELOPMENT REVIEW TO ALLOW
EXCEPTIONS TO THE PRIVATE OUTDOOR AREA AND SHARED OUTDOOR RECREATION AREAS
REQUIREMENTS, AND DECLARING AN EMERGENCY.(CPA 14-84)
WHEREAS, the City of 'Tigard adopted a Comprehensive Plan for the City by
Ordinance 83-52 on November 9, 1983; and
WHEREAS, the Community Development Code was adopted as a part of the
Comprehensive Plan; and
WHEREAS, the Comprehensive Plan was submitted to the Land Conservation and
Development Commission (LCDC) on November 18, 1983; and
WHEREAS, the Land Conservation and Development Commission held an
acknowledgement hearing on Tigard's Comprehensive Plan on April 26, 1984; and
WHEREAS, at the April 26, 1984, LCDC Hearing, the Commission voted to continue
acknowledgement or, Goal '#10 with in Order to Comply Statements; and
WHEREAS, a public hearing was held before the Planning Commission on June 12,
tl 1984, to consider the In Order to Comply Statements and a recommendation was
made to the City Council; and
WHEREAS, a public hearing was held before the City Council on June 25, 1984,
for Council consideration of the Planning Commission's recommendations.
NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Section 18.120.170 of the Community Development Code shall be
amended to add a new Section C as set forth below. Language
to be added is underlined. Language to be deleted is
(bracketed].
"Co The Director may grant an exception or deduction to the
Private Outdoor Area and Shared Outdoor Recreation Areas
Requirements provided the application is for a use designed
for a specific purpose which is intended to be permanent in
nature (for example senior citizens housing) and which can
demonstrate a reduced demand for Private Outdoor Recreaional
Area based on any one or more of the following findings:
"1. There is direct access by a pedestrian path, not
exceeding one-quarter mile, from the 2E osed
development to public open space or recreation areas
which may be used by residents of the development.
"2. The development operates a motor vehicle _whichis
P` available on a regular basis to transport residents of
the development to Eatjiic open ' space or recreation
areas=

113. The required square footage of either the Private
� Outdoor Area or the Shared Outdoor Recreation Area may
be reduced if together the two areas equal or exceed
the combined standard for both.
"[C.] D. The Director shall grant an exception to the landscaping
,. requirements of this code, Section 18.120.150, upon finding
that the overall landscape plan provides for a least 20

percent of the gross site to be landscaped.
ri "[D.] E. The Director's decision may be appealed as provided by
18.32.310(A). No notice of the Direcror's decision need be
given."
Section 2: Inasmuch as it is necessary for the peace, health, and safety
of the people of the City of Tigard that this amendment be
made with the least possible delay, an emergency is hereby
declared to exist, and this ordinance shall become effective
immediately upon passage by the Council and approval by the
Mayor.
