ORDINANCE NO. 84-0(,,
AN ORDINANCE AMENDING TMC SECTION 2.04.020, CITY ADMINISTRATOR, AND SECTION
2.16.020, MUNICIPAL COURT JUDGE, ADDING PROVISIONS FOR THE APPOINTMENT AND
REMOVAL OF THE CITY ATTORNEY AND THE RECORDER IN THE TIGARD KUNICIPAL CODE AND
DECLARING AN EMERGENCY.
In order to remove any question regarding the appointment and removal of
an official, the Tigard City Council desires to add the following language for
clarification to the Tigard Municipal Code.
NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 2.04.020 of the Tigard Municipal Code be amended by adding
the following language:
112.04.020 Appointment and Removal. The office of City Administrator shall
be filled by appointment [of] by the Mayor with the consent of the City
Council. The Administrator shall be the chief administrative officer of
the City, and as such shall be chosen solely on the basis of
administrativegualifi( •tions and experience, without regard to political
considerations. Appointment and removal of the City Administrator by the [
Mayor shall require the prior consent of a majority of the full Council
r recorded at a public meeting. '
SECTION 2: Section 2.16.020 of the Tigard Municipal Code be amended to read
as follows:
112.16.020 Municipal Judge. The office of Municipal Judge of the City of
Tigard as provided by Section 10 of Chapter III of the Charter, shall be
held by one incumbent [who shall be appointed by the Mayor with the
consent of the City Council, and may be removed by the Mayor with the
consent of the Council., who shall be appointed solely on, the basis of
qualifications and experience without regard to political considerations.
Appointment and removal of the Municipal Judge by the Mayor shall require
the prior consent of a majority of the full Council recorded at a public
meeting.
The compensation of the Municipal Judge shall be fixed by resolution of
the City Council."
SECTION 3: The following language shall be added to the Tigard Municipal Code.
"Recorder. The office of Recorder of the City of Tigard as provided by
Section 10 of Chapter III of the Charter, shall be filled by appointment
by the Mayor with the consent of the Council. The Recorder shall be
appointed solely on the basis of qualifications and experience and without
regard to apolitical considerations. Appointment and removal of the
Recorder by the Mayor shall require the prior consent of a majority of the
full Council recorded at a, public meeting."'

SECTION 4: The following language shall be added to the Tigard Municipal Code.
"Attorney. The City-Attorney shall beappointed by the Mavor with the
consent of the Council. The Attorney shall. be appointed solely on the
basis of qualifications and experience and without regard to political
considerations. Appointment and removal of the Attorney by the Mayor
shall require the prior consent of a majority of the full Council recorded
at a public meeting."
SECTION S: Inasmuch as it is necessary for the peace, health and safety of
the people of the City of Tigard that the foregoing amendments to the Tigard
Municipal Code become effective immediately to clarify the relationship
between the City officials and the City Council, an emergency is hereby
declared to exist, and this ordinance shall become effective upon its passage
by the Council, and approval by the Mayor.
