ORDINANCE NO. 34-05"
AN ORDINANCE PROVIDING FOR A FILING DEADLINE FOR THE OFFICES OF MAYOR c'`-. rn CITY
COUNCIL AND DECLARING AN EMERGENCY.
WHEREAS, the Charter provides that a Councilor shall submit a resigi.a ion in
order to run for Mayor when the council term and Mayor's term would run
concurrently; and
WHEREAS, the intent of the Charter provision is to provide for a continuous
five-member council and to preclude the need for a special election; and
WHEREAS, the Charter provision is silent on the date by which the resignation
must be submitted; and
WHEREAS. it would be possible for a Councilor to submit a letter of
resignation as provided by the Charter and a nominating petition for Mayor
immediately prior to the deadline date and time for filing for Mayor and thus
f preclude filling the vacancy at the next election as intended by the Charter;
and
WHEREAS, an ordinance is needed to implement the intent of the Charter to
assure the citizens of Tigard adequate notice of a vacant Council position and
adequate time to circulate a nominating petition to file for office;

SECTION 1: The following filing deadlines and procedures shall apply:
a. Except as otherwise provided by this Section, the filing deadline for
all, persons filing for the position of Mayor shall be the thirty first
(31st) day preceding the date the City Recorder is required by law to
transmit to the County Clerk a list of the offices to be filled and the
names of the persons to appear on the ballot; and
I. Within five (5) days after the filing deadline, the City
Recorder shall verify the signatures and shall provide a form to
the nominee stating that the correct number of signatures have
been submitted and that the signatures are valid; and
2. Within five days after receipt of the form from the City-
Recorder verifying the petition, the nominee shall accept or
decline the nomination and if the nominee is a councilperson
whose term would be concurrent with that of Mayor, the nominee
shall submit a letter of resignation as required by the'Charter.

b. The filing deadline for a City Council position shall be eleven (11)
days preceding the date the City Recorder is required by law to transmit
to the County Clerk a list of the offices to be filled and the names of
the persons to appear on the ballot; and
1. Within five (5) days after the filing deadline, the City
Recorder shall verify the signatures and shall provide a form to
the nominee stating that the correct number of signatures have
been submitted and that the signatures are valid; and
2. Within five days after receipt of the form from the City
Recorder verifying the petition, the nominee shall accept or
decline the nomination.
SECTION 2: In the situation where one of the dates listed in Section 1 falls
on a weekend or legal holiday, the time for filing shall be
extended to 4 pm on the following work day, however, this
extension shall not change any of the other prescribed dates.
SECTION 3: This ordinance is necessary for the peace, health, safety and
welfare of the people of the City of Tigard because it is vital
that the intent of the Charter be carried out to assure there is
adequate notice of a vacant Council position and adequate time to
circulate a nominating petition, and an emergency is hereby
declared to exist, and this ordinance shall become effective upon
its passage by the Council and its approval by the Mayor.
