AN ORDINANCE AMENDING CHAPTER 9.04 (PARKS - GENERAL PROVISIONS) OF THE TIGARD
MUNICIPAL CODE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Chapter 9.04 of the Tigard Municipal Code, relating to
Parks - General Provisions, be, and the same is hereby amended
and supplemented to read as follows;

9.04.010 Purpose: iie purposes of those riles and regulations are to:
(a) Facilitate maximum use of public facilities by the general public;
(b) Coordinate the use of park and recreation facilities, thus assuring
maximum opportunity for use through the convenience of advance reservations;
(c) Provide facilities at minimal cost to the general public, but where
exclusive use takes place or special handling is required, to assess the
appropriate fees;
(d) Coordinate the public use of facilities with maintenance,
construction and other activities (ORD. 78-13 51, 1978).
9.04.020 Facility reservation. In order to provide for the convenience
of advance reservation of park facilities, the following procedures are
adopted:
(1) The formal application must be made through city hall to reserve any
public park and recreation facility for the exclusive use of a particular
group.
(2) All applications shall include the name of the organization/group,
the facility requested, date and time requested, name, address and phone
number of person in charge, type of activity and any special requests.
(3) A responsible person in charge must sign the application and be
present at the function.
(4) City of Tigard, School district 23J, Tigard Little League and Tigard
Soccer Association sponsored programs shall be reserved through the Tigard
field use committee. (Ord. 80-95 52, 1980: Ord. 80-83 53, 1980: Ord. 87-13
52, 1978).
(5) Total reservations at any one time shall not exceed 500 people.

9 04.030 Establishment of fees and crediting of funds. The following
r fees shall be collected by the city administrator of his delegate and placed
in the appropriate account:
(1) A ten-dollar application fee shall be required for all park
reservation requests, and shall be placed in an account to be expended for
administrative activities.
(2) A fee shall be collected for reservation of facilities in community
and urban parks, as defined in the adopted park standards and placed in a fund
to be expended for park maintenance, according to the following schedule:
(A) For reserva+,c of picnic area (See section 9.04.050 for
definition of group classifications):
Group I Group.�II GroupIII

(B) For reservation of special areas or services:
Ball field $ 10
Special opening/closing 10 (each hour before/after
regular park rates)
For extended use of facilities, (i.e., several consecutive days or
weeks) the above fees will he char.-ed as a weekly rate,
(C) Ad::itional costs incurred by the city because of abuse or
excessive cleanup repair (as determined by public works department, i.e.,
A deposit for clearing of barbecue grates) shall be charged to the reserving
group creating the added costs. All such excessive cleanup/repair shall be
documented by public works and filed at city hall.
(An advance deposit may be required.)
a (D) Fees for special equipment and/or personnel unknown at the time
of application will be billed to the person in charge after the activity when
computation is accomplished.

(E) Use of agency facilities for fund raising will be handled on an
individual basis. Groups or individuals desiring to conduct fund raising
activities should .apply for a Special Use Permit on the Planning Department
application form and will be required to present their fee structure for
review. (Ord. 82-30 52, 1982; Ord. 80-83 54, 1980; Ord. 78-13 53,1978).
9.04.040 Refund of fees. (a) Any group seeking a refund because of
inability to use facilities as requested shall submit a written statement of
refund request, to include:
(1) Name of group, address and telephone;
(2) Name, Address and phone number of persons/group to whom refund
is to be paid;
(3) The reason for seeking the refund the amount requested.
(4) In no case shall the $10 application fee be eligible for refund.

(b) All refund requests must be approved by the city administrator. (Ord.
78-13 545 1978).
9.04.050 Definition of Group Classifications:
1 Fee Group Classifications.
(a) Group I. No fees; city-sponsored groups and programs, School
District 23J, local youth groups, low income groups, Tigard Little League and
Tigard Soccer Associations (bail fields oriiy);
(b) Group II. Fees as listed under Group II in Section 9.04.030
(2)(A), all nonprofit groups including churches, garden clubs, business and
social clubs, fraternal organizations and government agencies;
(c) Group III. Fees aG listed under Group III in Section 9.04.030
(2)(A), all other profit-making groups including company or corporate
sponsored activities.
9.04.060 Waiver of Fees. No waiver shall be granted except by approval
of the Park Board and the City Administrator and in accordance with the
following standards:
(1) Fees for facility reservation (Groups II) may be waived in whole or
in part on a discretionary basis for groups submitting written requests
detailing equal value services to the community."
Section 2: This ordinance shall be effective on and after the 31st day after
its passage by the City Council.
