Ordinance No. 83-44 CITY OF TIGARD, OREGON ORDINANCE NO. 83- AN ORDINANCE AMENDING A RESIDENCY REQUIREMENT FOR DEPARTMENT HEADS, ADDING PROBATIONARY PERIOD. WHEREAS, Ordinance No. 78-87 requires City residency under Chapter 2.06 of the Tigard Municipal Code, DEPARTMENT HEADS, for: City Administrator, City Recorder, Chief of Police, Planning Director, Public Works Director, City Engineer, Head Librarian, City Building Official and other department heads; and, WHEREAS, the City has reorganized and reduced the number of Department Head Dositions; and, WHEREAS, the City has an established probationary period of six months, but the ordinance provides for relocation into the City of new employees within four months; and, WHEREAS, the high costs and time delays necessary to buy and sell households create a disincentive, especially for local Oregon applicants, in applying for senior City positions; and, WHEREAS, the City desires not to place undue hardships on its senior staff, yet wishes to continue the residency requirements; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Section 2.06.010 of the Tigard Municipal Code shall be amended so that the following Section 2.06.010 of the Municipal Code shall read as follows, the underlined language being added and the bracketed language being deleted: 2.06.010 Residency Required--Affected Positions. All persons employed full-time by the City of Tigard in the positions named in this ordinance are hereby required to establish permanent residency within the city limits or within the area designated as Tigard's Immediate Urban Growth Boundary within 120 days following the end of the probationary period[appointment]. The affected positions are the following: City Administrator, [City Recorder,] Chief of Police, Planning Director, Public Works Director, [City Engineer,) Head Librarian, and Finance Director[City Building Official). Any person hired or appointed to be the chief administrative officer of any other- department of the City hereafter created shall also be required to comply with the terms of this ordinance. Section 2: Section 2.06.030 of the Tigard Municipal Code shall be amended so that.the following Section 2.06.030 of the Municipal Code shall read as follows: ORDINANCE No. 83 �I�/ t 2.06.030 Extension of time to comply. The city council may at its discretion extend the period for compliance with this ordinance[ an additional thirty days]. Such an extension may be given to any affected employee if that employee has made a demonstrable effort to comply[ by arranging for the purchase of a home within the city limits before the end of the applicable period, and the delay preventing full compliance as caused only by the delay in completing any required real estate transaction, and that delay does not arise on account of any fault of the employee]. (Ord. 78-87 §2(part), 1978).
