AN ORDINANCE VACATING A PORTION OF SW 72ND AVENUE/TOWER AREA, A PUBLIC
RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:

Section 1: The Council finds that Resolution No. 82- 72 was adopted by this
Council pursuant to ORS 271.100 on July 12, 1982, and related to the vacation
of a portion of 3W 72nd Avenue/Tower Area, a public right-of-way in the City
of Tigard, Washington County, Oregon. Resolution No. 82- 72 also called a
public hearing to be held on August 23, 1982, and directed that notice of said
hearing be given as required by ORS 271.110.
Section 2: The Council further finds that a public hearing as thereby called
to be held was duly and regularly held at the regular Council meeting on
August 23, 1982, at which time and place the Council afforded all interested

persons an opportunity to be heard for or against the proposed vacation of
said lands, and the Council further considered all objections thereto, in
accordance with ORS 271.080 to 271.120.
Section 3: The Council further finds that the City Recorder has certified
that all city liens and all taxes have been paid on the property proposed for
vacation and that a majority of the owners of the area affected by said
proposed vacation, computed on the basis provided in ORS 271.080, did not
object thereto in writing and that all owners affected thereby did, in fact,
favor the vacation of said area; and the Council finds that said vacation will
not substantially affect the market value of any abutting property.

Section 4: The Council further finds that the public interest will not be
prejudiced by the vacation of the hereinafter described portion of SW 72nd
Avenue/Tower Area and that the said land is not useful as part of the public L
street, utility or road system of the City of Tigard and that it is in the
public interest that said vacation be approved.

Section 5: The following described land is hereby vacated:
A tract of land being a portion of S.W. Upper Boones Ferry Road also known as G
Carmen Drive, in the southeast 1/4 of the southeast 1/4 of Section 12, T.2S., `
R.1W., W.M., City of Tigard, Washington County, Oregon more particularly t
described as follows:
Beginning at a point on the northerly line of Parcel 1 as shown on P.S. 11,021
of the Records of Survey of Washington County, Oregon that is N 46006'34" E 1
26.73 feet from a 5/8-inch iron rod at the northwest corner of said Parcel 1, K
said beginning point is also N 0021'36" W 177.89 feet and N 89038'24" E t
59.56 feet from the recognized southwest corner of the southeast 1/4 of the
southeast 1/4 of said Section 12 being Point No. 289 on County Survey No.
19,127; thence northerly along a 480 foot radius curve to the left through a
central angle of 2026124" (chord bears N 0051136" E 20.86 feet) 20.87 feet E
to a point that is 40 feet at right angles to the centerline of County Road

No. 126; thence N 0021136" E 45.83 feet to a point of curve; thence
northeasterly along a 40 foot radius curve to he right through a central angle
of 78052102" (chord bears N 39004'25" E 50.815 feet) 55.06 feet to a point
that is southerly 32 feet at right angles to the realigned offset centerline
of S.W. Carmen Drive; thence continuing along a line 32 feet southerly at
right angles and parallel to said centerline of S.W. Carmen Drive,
northeasterly along a 350.3099 foot radius curve to the left through a center
angle of 17024'13" (chord bears N 69048120" E 105.998 feet) 106.41 feet to
a point curve and spiral; thence continuing along a line 32 feet southerly at
right angles and parallel to the said realigned offset centerline
northwesterly (spiral along centerline Data - 180 CR; L = 120' Spiral;
S - 100481; a =15.0' e = 0.120) 4.1 feet more or less to the intersection
with the easterly line of said Parcel 1 of P.S. 11,021, also being the
westerly line of that tract described as Parcel XV of Fee No. 87-044276 of the
Records of Washington County, Oregon; thence southeasterly S 13033'09" W
more or less 12.3 feet more or less to a 5/8-inch iron rod at the most
northerly corner of said Parcel 1 on P.S. 11,021; thence southwesterly along
the northwesterly line of said Parcel 1 on P.S. 11,021; S 46006'34" W 191.49
feet to the Point of Beginning of the tract herein described.
Contains 6,921 Square Feet more or less.
Section 6: That the City Recorder be, and she is hereby authorized and
directed to have a certified copy of this ordinance filed for record with the
following Washington County departments:
1. Department of Records & Elections
2. Department of Assessment & Taxation - Attn: County Assessor
3. Department of Public Works - Attn: County Surveyor
Section 7: This ordinance shall be effective on and after the 30th day after
its enactment by the City Council, and approval by the Mayor, or until such
time as other right-of-way under the control of Forest H. Tower, and necessary
for the improvement of the 72nd Avenue protect, is dedicated to the City of
Tigard at no cost to the City.
