AN ORDINANCE VACATING A PORTION OF SW 72ND AVENUE/PAC TRUST, A PUBLIC i
RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:

Section 1: The Council finds that Resolution No. 82- 70 was adopted by this
Cou�nc pursuant to ORS 271.100 on July 12, 1982, and reTated to the vacation
of a portion of SW 72nd Avenue/PAC Trust, a public right-of-way in the City of
Tigard, Washington County, Oregon. Resolution No. 82- 70 also called a
public hearing to be held on August 23, 1982, and directed that notice of said
hearing be given as required by ORS 271.110.
Section 2: The Council further finds that a public hearing as thereby called
to be held was duly and regularly held at the regular Council meeting on
August 23, 1982, at which time and place the Council afforded all interested
persons an opportunity to be heard for or against the proposed vacation of
said lands, and the Council further considered all objections thereto, in
accordance with ORS 271.080 to 271.120.
Section 3: The Council further finds that the City Recorder has certified
that all city liens and all taxes have been paid on the property proposed for
vacation and that a majority of the owners of the area affected by said
proposed vacation, computed on the basis provided in ORS 271.080, did not
object thereto in writing and that all owners affected thereby did, in fact,
favor the vacation of said area; and the Council finds that said vacation will
not substantially affect the market value of any abutting property.
Section 4: The Council further finds that the public interest will not be
prejju iced by the vacation of the hereinafter described portion. of SW 72nd
Avenue/PAC Trust and that the said land is not useful as part of the public
street, utility or road system of the City of Tigard and that it is in the
public interest that said vacation be approved.
Section 5: The following described land is hereby vacated:
A tract of land being a portion of County Road No. 922 and County Road No.
A-138, in the Northeast .1/4 of Section 13, T.2S., R.1W., W.M., City of Tigard,
Washington County, Oregon more particularly described as follows:
Beginning at the point of intersection of the southeasterly right-of-way
of S.W. Upper Boones Ferry Road (County Road A-138) (60 feet wide) and the
easterly right-of-way of S.W. 72nd Avenue (County Road No. 922) (40 feet wide)
said point of beginning also lies S 0000'09" W 46.44 feet and S 89CI59151"
E 20.00 feet from the point of beginning of County Road No. 922 (shown as
point No. 289 on County Survey No. 19,127); thence S 0000'09" W along the
east right-of-way of said County Road No. 992, 481.820 feet to a paint of
curve; thence northwesterly along a 480 foot radius curve to the left through

a central angle of 28057'18" (chord bears N 14028130" W 240.00 feet)
f' 242.573 feet to a point on the westerly line of the widened S.W. 72nd Avenue
(40 feet at right angles to centerline); thence N 0000'09" E along the
westerly line of said widened right-of-way 81.45 feet to a 3/4-inch iron pipe
with Washington County Survey Plug; thence northewesterly along a 25 foot
radius curve to the left through a central angle of 131018127" (chord bears 1
N 65039104" W - 45.55 feet) 57.294 feet to a 3/4-inch iron pipe with a
Washington County Survey Plug, thence N 39023132" E in a straight line '
129.05 feet to a point that is S 61044'53" E 40.00 feet from the revised
centerline of S.W. Upper Boones Ferry Road and S.W. 72nd Avenue; thence S
61044153" E 22.26 feet to the Point of Beginning of the tract herein
described. `

Contains 16,383 Square Feet more or less.
Section 6: That the City Recorder be, and she is hereby authorized and
irected to have a certified copy of this ordinance filed for record with the
following Washington County departments:
1. Department of Records & Elections
2. Department of Assessment & Taxation - Attn: County Assessor
3. Department of Public Works - Attn: County Surveyor
Section 7: This ordinance shall be effective on and after the 30th day after
its enactment by the City Council, and approval by the Mayor, or until such
time as other right-of-way under the control of Pacific Realty Trust, and
necessary for the improvement of 72nd Avenue project, is dedicated to the City
of Tigard at no cost to the City.
