ORDINANCE NO. 82- Ll(?
AN ORDINANCE DETERMINING THE FINAL COST OF STREET AND SEWER IMPROVEMENTS IN
THE SOUTHWEST HAMPTON STREET LOCAL IMPROVEMENT DISTRICT (LID #22), RATIFYING
AND ADOPTING THE APPORTIONMENT AND ASSESSMENT OF THE, COST TO RESPECTIVE
PARCELS OF LAND WITHIN THE DISTRICT, SPREADING THE ASSESSMENT AND DIRECTING
THE ENTRY OF ASSESSMENTS IN THE LIEN DOCKET AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1. The Council finds that by Ordinance No. 81-08 adopted on February
23, 1581- the Council authorized and directed that the sewer and street
improvements within the boundaries of the SW Hampton Area Sanitary Sewer and
Street Local Improvement District (LID #22), as bounded and described in
Resolution 81-07, be undertaken by contract, and that that work has now been
completed.
Section 2. The Council finds that the total final assessable costs of the
improvements within the boundaries of the Improvement District is the sum of
$471,490.91, and the Council further finds that all lots, parcels or parts of
lots within the boundaries of the District as defined in Resolution 81-07 are
specially benefited and together shall bear equitable shares of the cost of
the improvement.
�. Section 3. The Council further finds that the apportionment of the cost of
the improvement upon each lot, part of lot or parcel, as prepared by the City,
and as set forth in the attached schedule, entitled "SW Hampton Sanitary Sewer
and Street Local Improvement District, #22," which by reference is made a part
of this ordinance, is according to the special and peculiar benefits accruing
to each from the improvement.
Section_ 4. The Council further finds that the City Recorder of the City of
Tigard has mailed or caused to be personally delivered to the owner of each
lot or tract proposed to be assessed a notice of assessment, which notice
stated the amount of the assessment proposed on that property and also stated
a date by which time objections should be filed with the City Recorder.
Section 5. The Council finds that at its special meeting of August 16, 1982
the City s final estimates of assessments and all objections filed with the
City Recorder were duly considered, and the City Council at that time
determined the assessment to be properly apportioned according to the special
and peculiar benefits accruing to each parcel, part of lot, or lot within the
Improvement District. Each lot, parcel, or part of lot as designated in the
attached apportionment schedule is hereby assessed and charged with the total
sum shown on the lien opposite, and the assessment shall constitute a lien
against each of the said properties from and after the passage of this
ordinance and entry in the City lien record as hereinafter provided.

Section 6. The City Recorder is hereby directed to enter each of the lots,
part of lots, or parcels and the amount of assessment against each, as shown
by the attached schedule, in the lien docket of the City separate from other
1 prior or subsequent assessments, and the same shall constitute a lien against
each respective lot, part of lot or parcel, and bear interest not to exceed
the rate prescribed by law for bond issues. [ORS 288.520 (2)]
Section 1. That inasmuch as it is necessary for the peace, health, and safety
of the people of the City of Tigard that the affected property owners be
notified of the assessment herein with the least possible delay, an emergency
is hereby declared to exist, and this ordinance shall become effective upon
its passage by the Council and signature by the Mayor.

Enclosed is the final assessment roll for S.W. Hampton Street, Local
Improvement No. 22. As of July 31, 1982, the final cost is $471,490.91.
The apportionment for the project is as follows:
City of Tigard (15 percent) $ 64,630.37
Hampton Street Tax Lots 366,238.78
67th Avenue Tax Lots 40,621.76
Total $ 471.490.91
The only change in the assessment method was to change the apportionment
of assessment on 67th Avenue. In the initial Public Hearing, the
Portland Farmers Insurance Group Federal Credit Union requested that
assessments be based on area rather than frontage.
