WHEREAS, the Boundary Conrdssion, established pursuant to Chapter 1666 �
494 Oregchagof98169, for the Metropolitan Area by its Final Order No.
dated approved the hereinafter described change
in the boundaries of the City of Tigard, and a copy of said Final Order
has been .filed with the City Recorder; and
WHEREAS, the City of Tigard, in accordance with Chapter 197 Oregon
lbvised Statutes, has adopted a comprehensive Plan which includes. the
lands within this Annexation.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION l: That themarml ?��r of the Boundarym-i

day of a copy whereof is hereto attached
and by this reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and tf
effect as if set forth herein in full.
SECTION 2: That the boundaries of the City of Tigard be, and they are
hereby changed to include the lands as described in the within
Order of the Boundary Commission, and the Corporate limits of the City
of Tigard are hereby changed in therewith.
SECTION 3: That the corder of the City of Tigard be, and she is hereby
directed to, forthwith file a copy of this Ordinance, including
a copy of said Order, in the following offices:

SECTION 6: Inasmuch as it is necessary for the peace, health and safety
of the people of the City of Tigard that the foregoing change in
the boundaries of the City become a permanent part of the City's records,
an nenwgency is hereby declared to exist, and this ordinance shall be effective
upon its passage by the Council, and approval by the Mayor.
PASSED: ByCd. r vote of all Council members present, after being

7dRE: BOUNDARY CHANGE PROPOSAL NO. 1666 - Annexation of territory to
the City of Tigard
Proceedings on Proposal No, 1666 commenced upon receipt by the Boundary
Commission of a resolution from the Tigard City Council on December 5,
1980 requesting that certain property be annexed to the city, The reso-
lution meets the requirements for initiating a proposal set forth in
ORS 199.490, particularly paragraph (a) of Section (1).
Upon receipt of the petition the Boundary Commission published and posted
notice of the public hearing in accordance with ORS 199.463 and conducted
public hearings on the proposal on January 15 and February 12, 1981, The
Commission also caused a study to be made on this proposal which considered
economic, demographic and sociological trends and projections and physical
development of the land.
FINDINGS

REASONS FOR DECISION
(See Reasons for Decision in Exhibit "A" attached hereto).

On the basis of the findings and reasons listed above, the Boundary
Commission approved BOUNDARY CHANGE PROPOSAL N0. 1666 on February 12, f
1981.
NOW THEREFORE IT IS ORDERED THAT the territory described in Exhibit "B"
and depicted on the attached map, be annexed to the City of Tigard as of
45 days from this date which is March 30, 1981, or at what other subsequent
date that the law requires.

Proposal No. 1666
N FINDTNGS
On the basis of the public hearing and the study the Boundary Commission
found that:
1. The territory contains only the rights-of-way of I-5 and 66th Ave.
2. The city desires annexation to extend the city limits to the
Portland city limits, its urban planning area boundary, in order to
regularize its boundary and plan for service provision within that
boundary.
3. The proposal creates an island of unincorporated lands surrounded by
the city to the west.
4. The territory is developed with low density residential uses. It is desig-
nated Urban on the Metro and Washington County Framework Plans. The
city plans the area primarily for commercial Office-Park.
S. The LCDC Goals have been considered and the proposal conforms with
the statewide goals. The staff report is referenced for a goal-by-
goal analysis
6. The territory is within the Metzger Water District which currently
serves the area. The district has several lines in the area. Metzger
Water District provides service for this area of the city and would not
be adversely affected by annexation. The district has planned supply
and storage adequate to serve the area.
7. The territory is within the boundary of the Unified Sewerage Agency.
The agency does not have a collector system available in the area.
Development of the industrial park will provide gravity service to
Fanno Creek, crossing under Iwy. 217 in the vicinity of Hunziker St.
The petitioners have also petitioned the city to form a Local Improve-
ment District to obtain sewer service. The city anticipates forming
the L.I.D. and planning the construction to serve all of the Tigard
Triangle area.
8.• Fire protection is provided by Washington County RFPD #1 which also
provides fzreservice for the city. The district would not be adversely
impacted by annexation.
REASONS FOR DECISION
1. The annexation is consistent with regional, county, and city plans and
with LCDC goals.
' 2. Annexation will make available a full range of urban services to the area
which is part of the Tigard community.
3. Annexation is a step toward regularizing the city boundary and improv-
ing planning implementation and police protection for the area.
