AMENDMENT TO THE 1970 ZONING MAP OF THE CITY OF TIGARD AND FIXING AN EFFECTIVE

THE CITY OF TIGARD ORDAINS AS FOLLOWS f
F
SECTION 1: Finding that the lands hereinafter described are now classified
as Washington County B-2 and RU-4, andfurther findings that
pursuant to procedures, the abovestated application for a zoning map
amendment was presented at a public hearing held by the Tigard Planning
Commission on March 3, 1981 and all interested persons were afforded an E
opportunity to be heard at this public hearing, the Council adopts the
following substantive findings:
P.. That this application is in conformance with the City of Tigard
CIS "Commercial Professional" zoning designation on the NPO #4
Plan which is a portion of the adopted Tigard Comprehensive Plan,
and
B. That the proposed zon?_ng is compatible with the surrounding
neighborhood as determined by the Tigard Planning Commission.
SECTION 2; Therefore, pursuant to the requirements of Chapter 16.88 of the
Tigard Municipal Code, this request for an amendment to the Zone
Map of the City of Tigard is hereby approved subject to provisions of
Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits
"A", "B", and "C"attached and made a part of this ordinance. The zoning
designation of the subject property is hereby changed to CP "Commercial
Professional".

And further subject to the following conditions:

1. Half street improvements shall be made to SW Franklin to collector
street standards. Half street improvements to local street standards
shall be made to SW 66th.
2. The applicant shall make half street improvements to SW 67th and
SW Gonzaga to local standards or vacate the right-of-way. The applicant
shall contact surrounding property owners affected by the street vacations
or improvements,and present a plan to the Public Works Director for approval.
3. All street improvements made to SW Franklin and SW 66th shall be approved
by the Public Works Department. Street improvements or right-of-way
vacations for SW 67th and SW Gonzaga shall also be approved by the Public
Works Department.
4. Grading and construction plans for all work in public rights--of-way
and all other public improvements shall be prepared by a registered
professional engineer in accordance with City standards, and shall be
submitted to the Public Works Department for review.
All public improvements will require a compliance Agreement and izaust
bee J an! 'pp 7'=ed by the "-Ui'.c iiveyia Department, weal mustbe either EMMEM
(1) fully and satisfactorily constructed prior to the issuance of ;
Building Permits; or (2) bonded to the City for 100% of the estimated
cost thereof prior to the issuance of Building Permits.
5. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspections
verifying this have been carried out by the appropriate department.
6. No changes will be made to approved plans or specifications unless Formal
application is made to the appropriate City department and changes are
approved by that department. Application for changes will be made in
writing and shall include applicable drawings.
.7. All proposed utilities shall be placed underground. Street lighting

installations shall be approved by the Public Works Department.

S. A metes and bounds legal description and map shall accompany any street ;
vacations and shall be prepared by a registered engineer or land surveyor:
9. All street and parking areas shall be concrete or asphalt. All sidewalks
shall be concrete,
10., No Building Permits shall be issued until the expiration of the twenty
(201 day appeal period from the date of approval.
11. No minor land partitions shall be made in reference to this project
unless formal application is made to the City of Tigard Planning
Department and the minor lased partition is approved and recorded.

SECTION 3: Inasmuch as it is necessary to the peace, health, and safety
of the public that the foregoing zone change in the City's
records become affective, an emergency is hereby declared to exist, and
this ordinance shall be effective upon its passage by the Council and
approval by the Mayor.

FINDINGS OF FACT:

1. The applicant's request is in c'onfor'mance wi zii the Comprehensive Plan
and the NPO #4 Plan.
2. At present, SW 66th Avenue and SW Franklin Street are paved but are not
improved to City standards. SW 67th from Hampton to Franklin is gravel.
Currently, the right-of-way for SW Gonzaga is not improved between °
SW 66th and SW 70th.
3. Sewer service and water are available to the site.
CONCLUSIONARY FINDINGS:
1. The proposed zoning is compatible with other uses in the area and conforms
to the Comprehensive Plan and the NPO #4 Plan.
2. Half street improvements shall be made to all streets surrounding the
property - SW 66th, SW Franklin, SW 67th and Sri Gonzaga. An exception
SW 67th if the owner vacates the right-of-way
cam be made for SW Gonzaga and
for these two streets.
3. In accordance with the Tigard Municipal Code, (reference Section 18.59.030)

1. Half street improvements shall be made to SW Franklin to collector
street standards. Half street improvements to local street standards
shall be made to SW 66 til.
2. The applicant shall make half street improvements to SW 67th and
SW Gonzaga to local standards or vacate the right-of-way. The applicant
shall contact surrounding property owners affected by the street vacations
or improvements,and present a plan to the Public Works Dise`ctar for approval.
3. All street improvements made to SW Franklin and S« 66t"M shall -k*-*. approved
by the Public Works Departne..t. Street improvements or right-of-way
vacations for SW 67th and SW tonzaga shall also be approved by the Public
Works Department.
4. Grading and construction plans for all work in public_ rights-of-way
and all other public improvements shall be prepared by a registered
professional engineer in accordance with City st.;ndards, and shall be
submitted to the Public Works Department for review,
Al2 public improvements will require a Comp,Uanca agreement and must
be (design) approved by the Public Works Department, and mustbe either
(1) fully and satisfactorily constructed prior to the issuance ofd
Building Permits; or (2) bonded to the City for 100% of the estimated
cost thereof prior to the issuance of Bu-ldirg
5. No Occupancy Permits shall be issued until all_nonai±-ira,4_ placed upon
this development by the City of Tiqard have been satisfied and inspections
verifying this have been carried out by the appopritc'r- department.
6. No changes will be made to approved plans or specifications unless formai
application is made to the appropriate City department and changes are
ajproved by that department. Application for changes will be grade in
writing and shall include applicable drawings.
7. All proposed utilities shall be placed underground. Street lighting
installations snz$_1 be approved by the Public Works Department.
S. A metes and bounds legal and map shall : accompany any street

9. All street and Parka ng areas shall! be concrete or asphalt. Ala sidewalks

10. No Building Permits shall be issued until the expiration of the twenty
(201 day appeal period from the date of approval.
