r AN ORDINANCE OF THE TIGARD CITY COUNCIL AMENDING TITLE 14 OF THE TIGARD MUNICIPAL CODE,
BUILDINGS AND CONSTRUCTION, BY UPDATING CODES AND FEES, FIXING AN EFFECTIVE D:kTE AND
DECLARING AN EMERGENCY.
WHEREAS, the City Council finds that Title 14 of the Tigard Municipal Code needs
to be revised with the newly adopted State of Oregon codes and fees as they relate to
"Buildings and Construction",
NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Section 14.04.050 of the Tigard Municipal Code, relating to Building
Permit Fees, be, and the same is hereby amended to read as follows:
"14.04.050 Building permit fees. Section 304(a) of the 1979 Edition
of the Uniform Building Code as adopted by Section 14.04.020 of the Tigard
Municipal Code is amended to read as follows:
"(a) No fees shall be exacted for work undertaken by the City of Tigard; by
the State of Oregon, its subdivision or agencies; by the Federal Government,
its subdivisions or agencies; by Washington County, or by any school district,
if the work be done by such governmental units' own employees.
"(b) No permit will be required for work involving less than $100.00
valuation where no structural changes are made.
"(c) Fees for the issuance of permits for circuses, animal shows, wild
west shows or similar exhibitions held in `ents shall be $100.00.
"(d) All fees for other activities condu ped within the purview of Title
14 of the Tigard Municipal Code shall conform to Section 304 (a) and 304 (b)
of the 1979 Edition of the Uniform Building Code adopted by Section 14.04.020
of the Tigard Municipal Code, except with respect to
"Plan-checking Fees. Group R-3 and M occupancies involving repeated use of
the same building plans covering residential units as part of one development,
thefee for plan-checking services with respect to the second and successive
permits shall be computed at the rate of $15.00 per permit.
"Fee Schedule. Fees will be as set forth in Table 3-A of the 1979 Oregon
Structural Specialty Code which was effective November 1, 1981."
Section 2: That Section 14.06 of the Tigard Municipal Code, relating to Code For The
Abatement of Dangerous Buildings, be, and the same is hereby deleted in full.
Section 3: That Section 14.12.010 of the Tigard Municipal Code, relating to the Plumbing
Code, be, and the same is hereby amended to read as follows:
"14.12.010 - State statutes--Oregon State Plumbing Specialty Code and
Administrative Regulations--Adopted. ORS 447.010 to 447.140, now in
effect, and the Oregon State Plumbing Specialty Code, as prescribed by the
Department of Commerce, and the Administrative Rules for the Oregon State
Plumbing Specialty Code, as adopted on July 1, 1981, by the Director of
Commerce of the State of Oregon, all with respect to the standards and
regulations of plumbing facilities within the State of Oregon are adopted as
the plumbing code of the City of Tigard and shall have the same force and
effect as though herein recited in full, and three copies of the said code
and the said regulations issued with respect thereto shall be maintained !
at all times in the office of the City Recorder and one copy in the office
of the Building Official."

Section 4: That Section 14.12.070 (5) (a) of the Ti_;ard Municipal Code, relating to
Plumbing Code, be, and the same is hereby amended to read as follows:
E " (5) Enforcement.
(a) Right of Entry.
Whenever necessary to make inspection to enforce any of the I
provisions of this chapter or of the state statutes or regulations
thereunder, or whenever the building official has reasonable cause to
believe that in any building or upon any premises plumbing work is being
installed or which has been installed after the effective date of this chapter,
in violation hereof, the building official may enter such building or °
premises at all reasonable times to inspect the same or to perform any
duty imposed upon the building official by statute or rules; provided, that d
if such building or premises is occupied, he shall first present proper t
credentials and request entry, and if such building or premises is unoccupied
he shall first make a reasonable effort to locate the owner or other person
having charge or control of the building or premises and demand entry. If
such entry is refused, the building official shall have recourse by law
to secure entry."
Section 5: That Section 14.12.0$0 of the Tigard Municipal Code, relating to
Plumbing Code, be, and the same is hereby amended to read as follows:
"14.12.080 Schedule of Fees. (1) Individual Fixture Fees. Except
that a minimum inspection fee of $15 shall apply for revision or alteration
of plumbing within an existing building, the following fees shall be
charged.
(a) For each plumbing fixture $ 7.50
(b) Sewer:
(1) For the first 100 feet or fraction thereof 30.00
(2) For each additional 100 feet or portion thereof 15.00
(c) Water Service:
(1) For the first 100 feet or fraction thereof 20.00
(2) For each additional 200 feet or portion thereof 15.00
(d) Storm and rain drain:
(1) For the first 100 feet or fraction thereof 30.00
(2) For each additional 200 feet or portion thereof 15.00
(e) Mobile home space: 25.00
(f) Mobile home utility lines (in a park or on private
property) 15.00
(2) Additional Miscellaneous Fees and Refunds:
(a) The fee to a governmental agency shall be determined by the
provisions set forth under ORS 190.003 to 190.110 for the purpose
of carrying out the respective responsibilities of each agency and
the fee shall be $40 per hour for each hour or any part thereof.
(b) A twenty—five dollar ($25) reinspection fee shall be charged
for inspection of violations found by the Department after the
second inspection.
(c) A partial refund of fees may be made by the Department upon written
request of the permit holder within sixty (60) days from the date the
permit was 'I.ssued and prior to commencement of any work authorized by the
permit. A service charge of ten dollars ($10) will be retained by the
Director.
(d) The fee to any person or governmental agency for specially requested
inspections or surveys shall be $40.00 per hour or any portion thereof.
(e) Manufacturers of mobile homes and/or prefabricated structures,
who choose to deliver their product prior to the completion of the
plumbing system, shall be required to submit an inspection fee of one

half the fixture fee or the minimum $15 fee, whichever is the greater.
This fee would be submitted to the agency which will make the on-site
inspection."
Section 6: Emergency. This ordinance being necessary for the immediate preservation
of the public peace, health and safety of the Cit y of Tigard, in order to
maintain uniform fees with Washington County and the State Uniform Building
Code, an emergency is hereby declared to exist and this ordinance shall
be in full force and effect immediately upon its passage by the Council.
