AN ORDINANCE APPROVING THE DOWNTOWN TIGARD REVITALIZATION PLAN
UNDER ORS 457.095.
On October 12, 1981, the Tigard City Council, per Ordinance
81-91, approved formation of the Tigard Urban Renewal Agency (TURA)
under ORS 457.035 and elected to be the governing body of that
agency.
Since that date, the Council, the Tigard Planning Commission,
the Tigard Downtown Committee, and the firm of Danielson, Driscoll&
Hess, Architects and Planners, have worked to complete an urban
renewal plan for Council consideration under ORS 457.095.
That plan, entitled "Downtown Tigard Revitalization Plan" ,
hereinafter referred to as "the Plan", and a background report
entitled "Downtown Tigard Revitalization Plan-Report" , hereinafter
referred to as "the Report" , have been prepared in accordance with
ORS Chapter 457 and are now before the Tigard City Council for
consideration and final action after a public hearing advertised
in the Tigard Times for this date has been held and the recommenda-
tions of the Tigard Planning Commission and citizens of Tigard have
been considered.
The Council finds and determines that the Plan is consistent
both with the State-Wide Planning Goals, especially Goal 9 Economy
of the State, and has been prepared in accordance with ORS 457.085.
Now, therefore,
IT IS ORDAINED BY THE CITY OF TIGARD:
Section 1. On the basis of Council review of the Plan and Report,
consideration of testimony and other submission of
views of the citizens of Tigard at a public hearing held this date,
and otherwise, and the recommendations of the Tigard Planning
Commission, the Downtown Tigard Revitalization Plan is hereby
adopted and approved in accordance with ORS 457 .095.
Section 2. The City Recorder shall cause to be published within
four days of adoption of this ordinance in the Tigard
Times, a newspaper of general circulation in Tigard, the notice
of adoption of this Plan under ORS 457.095 and 457.115. The Tigard
Times shall also be used for publication of the annual financial
statement of the TURA.
Section 3. The City Recorder shall file a certified copy of this
ordinance, the Plan and the Report with the Director
of Records & Elections of Washington County, all in accordance with
ORS 457.125.
ORDINANCE NO. 81-
_Section 4. The Council finds, determines and concludes:
a. That the Urban Renewal Area, as described in Exhibit 2,
Part 2 of the Plan, is a blighted area, as defined by ORS 457.010 (1) ,
based on Parts A, C, and D of the Report.
b. The rehabilitation and redevelopment of the blighted area
is necessary to protect the public health, safety and welfare of
Tigard based on Parts A-D of the Report. In addition, the Council
finds, determines and concludes that the area is the central core
of Tigard. The lack of adequate streets, storm sewers and drains,
and parks and the presence of traffic conflicts and parking diffi-
culties provide a further basis for Council determination :for
approval of the Plan.
c. Tigard has no Economic Development Plan; however, the
Planning Director advised the Council, and we so find, determine
and conclude that the Plan conforms to the Tigard Comprehensive
Plan, particularly NPO Plan No. 1. No land use changes from the
NPO Plan Map are proposed by the Plan. See §700 (B) (3) of the Plan.
The NPO No. 1 Plan provides an outline for accomplishing the projects
proposed by the Plan approved by this ordinance.
d. There are no persons proposed to be displaced by the
projects proposed by the Plan. See 5700(B) (3) of the Plan and
Part I of the Report. To the extent that ORS 457.095 (4) is appli-
cable, the Council finds, determines and concludes that it has been
met by the Plan and Report provisions described hereinbefore and
which are adopted by this ordinance as city policy for the urban
renewal area described in Exhibit 2, Part 2 of the Plan.
e. Property to be acquired is described in §700 (B) (2) of
the Plan. Each of the parcels described therein for street and
railroad improvements, for Fanno Creek Park, and for parking
improvements is necessary for public use and implementation of the
Tigard Comprehensive Plan. The street and railroad and parking
improvementsarenecessary to provide access, improve traffic
circulation and safety and for the economic well-being of the city
and its residents. The proposed park acquisition areas are necessary
to provide recreational opportunities for residents and visitors
of the city and to fulfill State-Wide Planning Goal 8 of the Tigard
Comprehensive Plan.
f. Based on SS 700 and 800 of the Plan and Parts A to H of
the Report, the project is economically sound and feasible.
Section 5. The City of Tigard shall assume and complete the
activities presented it in the Plan.
