THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described are now classified
as A-12 "Urban Medium Density Multifamily Residential" and
C-4 "Residential Commercial'!, and further findings that pursuant to procedures,
the abovestated application for a zoning map amendment was presented at a
public hearing held by the Tigard Planning Commission on September 2, 1980.
All interested persons were afforded an opportunity to be heard at this
public hearing and thereafter the Planning Commission filed its report with
the City Recorder, a copy hereto attached and by reference made a part
of. The Council adopts the fallowing substantive findings:
A. That this application is in conformance with the A-12 "Urban Medium
Density Multifamily Residential" and C-4 "Residential Commercial"
designation on the NPO #6 Plan which is a portion of the adopted
Tigard Comprehensive Plan, and
B. That the proposed zoning is compatible with the surrounding neighborhood
as deter ined by the Tigard Planning Commission.
SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the
Tigard Municipal Code, this request for an amendment to the
Zone Map of th%, City of Tigard is hereby approved subject to provisions
of Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits
"All, "B", and "C" attached and made a part of this Ordinance. The zoning
designation of the subject property is hereby changed to A-12 "Urban Medium
Density Multifamily Residential" and C-4 "Residential Commercial' .

1. Half-street improvements will be made forty-five (45) feet from the
centerline of SW Hall Blvd. to allow for a future ninty (90) foot right-o£-way.
Improvements include curbs and sidewalks. €
2. A traffic analysis of the proposed project impact on SW Hall Blvd.
and SW Durham Road will be submitted to the City of Tigard. The findings
shall be reviewed by O.D.O.T.
3. I=rovements to SW Hall Blvd. shall be approved by O.D.O.T.
4. Site drainage plans shall be approved by the Planning Director and ,
Public Works Director.
5. Final approval of this project is subject to Site Design Review by
the Planning Director.
6. The project shall be reviewed by the Tigard School District.
7. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspections
verifying this have been carried out by the appropriate department.
8. No changes will be made to approved plans or specifications unless
fdrrmal application is made to the appropriate City department and changes
are approved by that department. Application for changes will be made
in writing and shall indlude applicable drawings. ;
9. Grading plans and construction plans on all public rights-of-way shall
be submitted and approved by the Public Works Director prior to commencement
of work.

10. Public water service and sanitary service shall be installed to this
site prior to the issuance of Occupancy Permits.
11. All existing or proposed utilities shall be placed underground. Street
lighting installations shall be approved by the Public Works Director.
12. No BuildingiPermits shall be issued until the expiration of the twenty
(20) day appeal period from the date of approval.
13. Improvements may be bonded prior to issuance of building Permits,
14. Dedication along the south caundary sufficient to Provide forty-five
(45) feet of right-of-way from the centerline of Durham Road shall
be made; and nonrenonstran.ce agreements for a Durham Road LID shall
be made a portion of the final plat, and made a part of each deed.
SECTION 3: This ordinance shall be filed with the recording office of Washington
County. This ordinanace is not effective until so filed according
to OILS 92.048 (4) .

STAFF NARRATIVE:
The NPO #)6 Plan alloses for a mixture of apartments and commercial professional
uses in a Residential Commercial Zone which coincides with the applicant's ;
proposal. The applicant is requesting the A-12 designation to ensure that the -
proposed use will be allowed to continue. A small neighborhood commercial
use is acceptable. A large retail use is not appropriate for this site. e
I. FINDINGS OF FACTS
1. The IPO #6 Policy allows for a maximum of twelve (12) dwelling units to
the acre in a multifamily zone. --

2. The site is not within any drainage basin, floodplain, sensitive lands
area or greenway.
3. The area to the north is vacant land; to the west are single family homes
and duplexes; Tigard High School is to the southwest while an industrial
park lies to the south. The Tigard Water Treatment Plant is to the
southeast of the site �..;.
4. Sewer service is available to the site off of Durham Road.
5. SW Hall Blvd. and SW Durham Road are designated arterial streets in the
Tigard Municipal Code.

Jr. CONCLUSIONARY FINDINGS:
1. The proposed seventy-two (72) units are the maximum allowed in the A-12
Zoning on 9.66 acres.
2. Half-street improvements will be needed on SW Hall Blvd. and SW Durham Road.
3. Increased traffic loads could create problems at the intersection of
SW Hall Blvd. and SW Durham Road. The applicant should work with the
Oregon Department of Transportation (O.D.O.T.) on this intersection.
4. The Tigard School District should be contacted regarding the impact of
the proposed project on schools.
III. STAFF RECOMMENDATION:
Staff recommends approval of a Comprehensive Plan Revision for this site
subject to the following conditions:
1. Half-street improvements will be made forty-five (451) feet from the
centerline of SW Hall Blvd. to allow for a future
ninty (901) foot right-of-way. Improvements include curbs and sidewalks.
2. A traffic analysis of the proposed project impact on SW Hall Blvd. and
SW. Durham Road will be submitted to the City of Tigard. The findings .
