THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described are now classified
as C-PPD "Commercial Professional Planned Development District",
and further findings that pursuant to procedures, the abovestated application
for a zoning map amendment was presented at a public hearing held by the
Tigard Planning Commission on September 2, 1980. All interested persons
were afforded an opportunity to be heard at this public hearing and thereafter
the Planning Commission filed its report with the City Recorder, a copy
hereto attached and by reference made a part of. The Council adopts the
following substantive findings:
A. That this application is in conformance with the C-PPD "Commercial
Professional Planned Development District" designation on the
NPO #4 Plan which is a portion of the adopted Tigard Comprehensive
Plan, and
B. That the proposed zoning is compatible with the surrounding neighborhood
as determined by the Tigard Planning Commission.
SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the
Tigard Municipal Code, this request for an amendment to the
Zone Map of the City of Tigard is hereby approved subject to provisions
of Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits
"A", "B", and "C" attached and made a part of this Ordinance. The zoning
designation of the subject property is hereby changed to C.-PPD "Commercial
Professional Planned Development District".

2 . The City of Tigard Comprehensive traffic plan for the area must be

3. Alignment of public streets and private drives through the project
shall be approved by the Public Works Director.
4. The project shall be reviewed and approved by the Fire Marshall.
5. The applicant shall apply for Sensitive Lands Permits for construction
of all buildings on slopes.
6. All phases of the project shall be individually submitted to the Planning
Director for Site Design Review.
SECTION 3: This ordinance shall be filed with the recording office of Washington
County. This ordinance is not effective until so filed according
to ORS 92.048 (4) .
SECTION 4: This ordinance shall be effective immediately after its passage
by the Council and approval of the Mayor.

REQUEST: For a Zone Map Amendment from C-3 "General Commercial" to

as indicated on the Comprehensive Plan and a height variance
from thirty-five (351) feet to seventy-five (751) feet.
LOCATION: East side of 72nd and on the north side of Atlanta continuing
to the north side of 67th/Atlanta intersection and on the west
# side of I-5 (Wash. Co. Tax Map 151 36DA, Tax Lots 100, 101,
102, 902 & 2300) .
I. FINDINGS OF FACT:
1. The applicant's request for a C-PPD Zone is in compliance with the
Comprehensive Plan.
2. NPO #4 Policy #27 allows building heights up to seventy-five (751) feet
between Interstate 5 and 68th Avenue. Most of the land on this site
lies between 68th Avenue and Interstate 5.
II. CONCLUSIONARY FINDINGS:
1. The property should be zoned in compliance with the Comprehensive Plan.
2. There are currently three (3) commercial-professional buildings on the site.
3. The seventy-five (75') foot building will be constructed on lower ground
than the other buildings on the site. The building will not extend above
the other buildings on the campus. Although the height will be noticed
at ground level, the impact will not be significant in terms of overall
effect.
4. Adjacent uses to the site presently include a u-haul truck storage And, a
mini-storage warehouse. This proposed project should not adversely
impact these uses.

Staff recommends approval of the Zone Map Amendment from C-3 to C-PPD with
the following conditions:

Staff recommends approval of the variance from thirty-five (351) feet to

Dear Sirs:
The following items address the questions that are raised in the application
for zone change.
1. The Oregon Education Association requests a zone change for their property. ;
They wish to bring into-conformance the zoning on their property with
respect to Tigard's adopted comprehensive plan.
2. The present use of the property is Professional Office and zoned C-3 General
Commercial. The proposed use will continue Professional Office and remain
in conformance with the comprehensive plan.
3. The Professional Office complex on this site serves not only a significant
amount of employees but also provides services to the general public through
the various renters of this complex. 1

4. There should be little change on environmental; economic or social conditions
in relation to this property. Even when it is fully developed it will remain
in the intended use which should reinforce the environmental, economic and
social aspects anticipated by this use.
5. The proposed location is already used and will continue to conform to the
present Tigard plans.
6. The impact on the immediate neighborhood will not change from what it has
been for the 'last twelve years. Increased traffic during early morning and
late afternoon hours is probably the most significant impact on the immediate
neighborhood. However, street access and improvement will continue as the
site develops more.
7. Because it has been and will continue to be a Professional Office Complex the
requirements of public services will remain as they are now. Utilities are
existing and roads will be built or improved as the development continues.

8. The initial site was developed under Phase I construction in 1963. They
are now planning for a Phase II construction project dealing with a
three story office building. Final phases for full development of the
site are indeterminate
9. The Oregon Education Association plans on selling the property to the
East and gest of their 10 acre site. However, it has been recommended
by the Tigard City Planning Staff to include in the zone: change those
pieces of property for sale. See attached site plan.
10. At present S. W. Atlanta Street is dead ended on the South side of the
site. The continuation of Atlanta Street, as shown on the attached site
plan, is in keeping with the city's anticipated road layout. The access
road shown in the south east corner of the site is an agreeable access to
the east side property. In addition a service road on the north end of
the' site could be used as a connection between the east and west property.
