Ordinance No. 80-76 f F t r. t CITY OF TIGARD, OREGON ORDINANCE No. 80- 76 AN ORDINANCE AMENDING SECTION 5.04.100 OF THE TIGARD MUNICIPAL CODE BY DELETING REFERENCE TO CONFINEMENT IN JAIL AND REDUCING MAXIMUM FINE, AND DECLARING AN EMERGENCY. Section 5.04.100 Violation--Penalty of the Tigard Municipal Code deals with penalties for violation of Code sections concerning business licenses. In order to make the penalties consistent with other penalties for offenses characterized as violations by the Code, it is necessary to delete from 5.04.100 the clauses referring to confinement in jail, and to reduce the maximum fine from $200 to $100. NOW, THEREFORE, the City of Tigard does ordain as follows: Section 5.04.100 of the Tigard Municipal Code is amended as follows: (1) By deleting the words "or by confinement in the county jail for not more than 90 days, or by both such fine and imprisonment." (2) By reducing the maximum fine from $200 to $100. As a result of these amendments, 5.04.100 shall read as follows: 5.04.100 Violation--Penalty. Any person violating any of the provisions of this chapter shall, upon conviction thereof in the City Court, be punished by a fine of not more than $100. Whereas, the immediate operation of the provisions of this ordinance is necessary for the preservation of the public peace, health, and safety, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor.
