Ordinance No. 80-71 (-TTY OF TIGARD, OREGON ORDINANCE No. 80- 71 AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN THE CITY OF TIGARD, OREGON, ON NOVEMBER 4, 1980, IN CONNECTION WITH THE STATE-WIDE GENERAL ELECTION, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY OF TIGARD, OREGON, THE QUESTION OF ESTABLISHING A NEW TA1. BASE PURSUANT TO SECTION 11, ARTICLE. XI, CONSTITUTION OF THE STATE OF OREGON AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Tigard, Oregon has determined that a new tax base should be established as authorized by Article XI, Section 11, of the Oregon Constitution, in order to permit the proper operation of the City's affairs within constitutional limits; and i E WHEREAS, it is required by State law that a new tax base shall be submitted to ! the legal voters of the City of Tigard for their approval; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TIGARD: Section 1: The Council finds that it is necessary and in the best interests of the people of the City of Tigard that there be submitted to the legal voters of the City at the regular state-wide general election to be held and conducted at all voting precincts within the City and throughout the state on November 4, 1980, and as a part thereof, the proposition hereinafter stated in accordance with Section 11, Article XI, Constitution of the State of Oregon. Section 2: That there should be submitted to the legal voters of the City of Tigard voting at each precinct, or part thereof, within the City at the said general election of November 4, 1980, the following proposition for which purpose the following ballot title, number and form in which the question shall be printed upon the official ballot is presented: SAMPLE BALLOT City of Tigard, Oregon { Special Election - November 4, 1980 t F TAX BASE PROFOSAL QUESTION: Shall the City of Tigard establish a new tax base of $562,098 to be effective in fiscal year 1981-829 F PURPOSE: This new tax base would finance police, parks, library, streets, and other services to city residents with state revenues offsetting part of the cost. This measure submits for voter approval, a tax base of $562,098 effective July 1, 1981. Future taxes levied within the proposed new tax base would be partially paid by the State under existing state law. EXPLANATION: The present City tax base was established in 1968. Today it is not sufficient to fund City services such as police, library, parks, ;and streets. In order to continue providing the present level of services, the City must receive additional revenues. If this measure is approved, the estimated tax would be $1.10 per $1,1000 of assessed value. Taxes levied within the tax base would be partially funded by the State. Section 3: The City Recorder is hereby authorized and directed to certify in the manner provided by law to the Department of Records and Elections of Washington County, the foregoing measure for inclusion as a part of the regular ballot to be prepared by the Department of Records and Elections for voting at all precincts within the City of Tigard at the state—wide general election of November 4, 1980. Section 4: In all respects the conduct of the election on the tax base proposition shall conform to the procedures established pursuant to law for the conduct of the general election in said precincts and the polls shall be opened at the same hour and closed at the same hour and all other applicable provisions in accordance with the election laws of the State of Oregon shall be respected. Section 5: Notice of the City tax base proposal in form substantially as hereinafter set forth shall be given by three weekly publications in the Tigard Times on October 15, 22, & 29, 1980, and by posting notice substantially in the following form in the following designated places, such posting by accomplished not later than October 10, 1980: (a) At the front door of the City Hall exposed to public view, 12420 SW Main Street, Tigard, Oregon. (b) In one public place in each voting precinct, or part thereof, within the City. (c) At each polling place. The City Recorder is directed to cause to have published and posted said notices and shall file in the records of the City, an affidavit of posting in usual form prior to October 17, 1980. The form of notice shall be substantially as follows: NOTICE OF PROPOSAL TO ESTABLISH A NEW TAX BASE CITY OF TIGARD, OREGON TO BE SUBMITTED TO LEGAL VOTERS OF TIGARD AT GENERAL ELECTION OF NOBVEMBER 4, 1980 Notice is hereby given that pursuant to Ordinance No. 80-_u enacted by the City Council of Tigard on August jXF, 1980, at the State of Oregon general election of November 4, 1980, between the hours of 8:00 o'clock A.M. and 8:00 o'clock P.M. at each precinct within the City of Tigard, there will be submitted to the legal voters of the City of Tigard for their approval or rejections, a tax base proposal as set forth in the following facsimile sample ballot: f SAMPLE BALLOT CITY OF TIGARD, OREGON Special Election November 4, 1980 TAX BASE PROPOSAL PAGE 2 ORDINANCE', No. 80-�� _ _. The foregoing proposition, if adopted, will establish a new tax base for the City of Tigard pursuant to Section 11, Article XI, Oregon Constitution. The polling places in the City of Tigard for the purpose of submitting the foregoing proposition will be the same as those designated for the state-wide general election of November 4, 1980, and the election will be conducted in all respects by the same election boards as designated and appointed for the state- wide general election. BY ORDER OF THE CITY COUNCIL Doris Hartig, City Recorder Section 6: That the Council of the City of Tigard deems it unnecessary for the City of Tigard, or any officer thereof, to furnish the legal voters of the City any tax base election pamphlets containing the text of the proposition or arguments in support of or in opposition to the proposition. Section 7: It is necessary for the preservation of the public peace, health and safety of the people of. the City of Tigard that this ordi:iance take effect immediately in order that the tax base proposal may be properly submitted to the people of the City of Tigard at the state-wide general election of November 4, 1980, and an emergency is hereby declared to exist and this ordinance shall be effective upon its passage by the Council and signature of the Mayor.
