Ordinance No. 80-70 CITY OF TIGARD, OREGON ORDINANCE NO. 80- Ja AN ORDINANCE DESCRIBING RESPONSIBILITY OF POLICE DEPARTMENT f WHEREAS, the Tigard City Council has recently undertaken a detailed study of the workings of the Tigard Police Department, and has received and discussed certain recommendations concerning the structure of the department, the relationship of the department to the administrator and to the City Council, and the department's needs regarding internal organization, and WHEREAS, it appears that the relationship between the city's ;, charter, the City Council and the Police Department ought to be set out in more detail than in the past in the Tigard Municipal Code, now, therefore, the City of Tigard ordains as follows: Section 1. Establishment of Police Department. Primary responsi- ity for law enforcement is placed with the Police Department. The Police Department for the City of Tigard shall consist of a Chief of Police and as many employees as the City Council may designate from time to time. Section 2. Responsibilities of the City Administrator. The City Adm�mi otrator is responsible for the overall operations of the } Police Department and, with direction from the City Council and advice from the Police Chief, shall formulate lawful policy ! relating to the goals, objectives, and priorities of the Police Department, and their relationship to general municipal strategies. 4i 4 Section 3. Appointment and Removal of the Chief of Police. The Chx-ref of Police shall be appointed by the City .Ad5:n. strator from � a list of eligible candidates supplied by the personnel officer. The Chief of Police shall serve at the pleasure of the City Administrator and may be removed by the City Administrator at any time, for cause. Section 4. Supervision and Control of the Chief of Police. The Cit�dministrator shall be the immediate supervisor of the Chief of Police, and all policies, directives, and orders from the city government to the Chief of Police shall be made by, or transmitted through, the City Administrator as the chief execu- tive of the city government. Section 5. Responsibilities and Authoritx of the Chief of Police. The CChIeF of Policeshall stab ish written;anew e-re possible quantifiable and measurable, goals and objectives based on poli- 4 cies transmitted to him by the City Administrator, and shall be responsible for directing the administration and. operations of � r, .j 2 the Police Department toward the achievement of these goals and objectives through written policies, procedures, and rules, and through personal leadership. The Chief of Police shall provide for an annual public review and evaluation of all department goals and objectives, and progress made toward their achieve- ment. The Chief of Police shall recommend to the City Adminis- trator qualified persons for appointments to all vacant posi- tions within the department other than his own, and the Chief of Police shall have the authority to suspend or dismiss any member of the Police Department subject to the approval of his action by the City Administrator.
