AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION FOR AN AMENDMENT
TO THE 1970 ZONING MAP OF THE CITY OF TIGARD AND FIXING AN EFFECTIVE DATE.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described are now classified as
R-7 "Single Family Residential" and M-4 "Industrial Park zone",
and further findings that pursuant to procedures, the abovestated application
- for a zoning map amendment was presented at a public hearing held by the
Ti gam d PlarMing COr- iSsion on May 20, 1980. All interested persons were afforded
an opportunity to be heard at this public hearing and thereafter the Planning
Commission filed its report with the City Recorder, a copy hereto attached and
by reference made a part of. The Council adopts the following substantive
findings:
A. That this application is in conformance with the R-7PD "Single
Family Residential Planned Development" designation on the
NPO # 1 Plan which is a portion of the adopted Tigard Comprehensive
Plan, and
B. That the proposed zoning is compatible with the surrounding
neighborhood as determined by the Tigard Planning Commission.
SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the
Tigard Municipal Code, this request for an amendment to the Zone
Map of the City of Tigard is hereby approved subject to provisions of Chapter
18.20 of the Tigard Municipal Code as embodied in adopted Exhibits "A", "B",
and "C" attached and made a part of this Ordinance.

And further subject to the following conditions:
1. ' Project shall be subject to Site Design Review.

2. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspections
verifying this have been carried out by the appropriate department.
3. No changes will be made to approved plans or specifications unless formal
application is made to the appropriate City department and changes are
approved by that department. Application for changes will be made in writing
and shall include applicable drawings.
4. Grading plans and construction plans on all public right-of-ways shall be
submitted and approved by the Public Works Director prior to commencement
of work.
5. Public water service and sanitary service shall be installed to this site
prior to the issuance of a Building Permit.
b. All existing or proposed utilities shall be placed underground. Street
lighting installations shall be approved by the Public Works Director.
7. No Building Permit shall be issued until the expiration of the twenty
(20) day appeal period from the date of approval.
B. Improvements may be bonded prior to issuance of Building Permits.
�J. 9. That street improvements be constructed to the approval of the Public
Works Director prior to the recording of the final plat or issuance of a
Building Permit.
10. The concerns of the Fire Marshall shall be satisfied at the Site Design
Review level.
11. Compacted gravel parking spaces shall be provided to meet the Code requirements
to the north of the building in "future parking" area.
12. That half-street improvements be made to O'Mara Street to the satisfaction
of the Public Works Director.
SECTION 3: This Ordinance shall be effective immediately after its passage by
the Council and approval of the Mayor.

,Subject: Response to Conditional Use Application Procedure, Part D, items 1-7.
1. The nature of the proposal is to allow the site described in accompanying
documents to be used for the new Tigard Senior Center, a facility to
eventually accommodate approximately 200 persons for nutrition and multi-
use programs.
2. The proposed use is an allowable conditional use for an R-7 zone under
section 18.20.020 of the Tigard Municipal Code, part 6 or 7, "Community
Building, public" or "Public Building The R-7 zoning of this property
is in conformancewith the adopted comprehensive plan of the City of
Tigard. The facility contemplates no construction in the flood plain
and proposes only casual recreational use.
3. As a public faci,ity, the City of Tigard has established over a lengthy
period of time the benefit to the public of operating a multi--purpose
center for senior citizens in the city.
4. During prior proceedings the suitability of the site for P.-7 development
was considered by the Planning Commission for another owner. It was found.
not suitable because a major portion of the property lies in the, proposed
greenway slang Fanna Creek and R-7 density could not be achieved. The
property then became unmarketable as R-7 development. The marketplace
then determined a "highest and best use" for the site and the city was
able to respond by purchasing it as an ideal site for the center,

6- The site. was selected by the City of Tigard for its. location,.. relation
to improved streets, proximity to mass transit:, avai l'abi l i ty of-mti-1
ities and its relationship to the Fanno Creek Greenway Park, as well as
cuss. The site is surrounded or, three sides by public areas (a church
and the greenway) and will provide public access to the greenway.. The
facility will help alleviate the burden on other public facilities in
Tigard. The facility will impact the adjacent residential property
owner both by, improving the now unkept property and by increasing the
traffic and density of use. ":

PREVIOUS ACTION:
Land purchased by City of Tigard with Washington County Block Grant Funds.
The Senior Center Committee and the firm of John Kyle Architect has been
primarily responsible for the development of plans to date. ,
I. FINDINGS OF FACT:
1. The majority of the project is presently zoned. R-7. A small portion of
the property to the north within the onehundred year floodplain just across
Fanno Creek is zoned. M-4.
2. Chapter 18.20 of the Code, Section ,020 allows Coumiunity Buildings (Public)
as a Conditional Use in a R-7 zone.
3. Section 18.60.120 (3) (a) of the Code requires one {1} parking space for
each sixty (60) square foot of gross floor area for public buildings.
Site plan specifies 7200 gross square feet which equates to 120 parking
spaces. Subsection (3) (b) under clubs. specifies one (1) parking space
per 100 square foot gross floor area which equates to 72 parking spaces.

16 spaces for a total of 59 spaces. This requirement could be "adjusted"
due to the expected use of the building for a senior center, use of mass
transit facilities and the fact that this building is not "totally public
for assemblies, nor is it a "lodge or club" in the strict sense of the word.
The possibility to enlarge the parking area in the future Gould meet the
Code requirements.
4. The Fire Marshall has reviewed the general site plan and suggests that the
"Deadend" driveway to the west service entrance be changed to allow a turnaround
for all vehicles. A fire hvdrant shall be installed within 250' of any part of the
bili ldlny or dile bididing 5liall by sprinkled.
5. The Sensitive Lands Ordinance requires that land within floodplain be
designated Planned Unit Development and be brought before the Planning
Commission for review. In this case no part of the structure or parking
lot encroaches into the floodplain. The Sensitive Lands permit is
included/requested only to satisfy the requirements of the Code. A
sewer line installation will go north and will go into the floodplain.
The Public Works Director will supervise this work.
6. A sidewalk installation along the north side of O'Mara to Hall Boulevard
is anticipated to be funded through H.U.D. next year.
II. CONCLUSIONARY FINDINGS:
1. The use of this property is in conformance with the Comprehensive Plan
designation and the Code.
2. This development can be served with water and sewer service. Public
transportation is available within a reasonable distance.
3. All general/specific guidelines established by H.U.D. through the Washington
County Block Grant Pragram have been complied with or will be before
completion.
