ORDINANCE NO. 80-
AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN AMENDMENT TO THE 1970 ZONING
MAP OF THE CITY OF TIGARD TO CONFORM WITH THE TIGARD COMPREHENSIVE PLAN AS
ADOPTED AND FIXING AN EFFECTIVE DATE.

WHEREAS, the Boundary Commission, established pursuant to Chapter 494
Oregon Laws of 1969, for the Portland Metropolitan Area by its final order
#1543, dated February 7, 1980 approved %he hereinafter described change in the
boundaries of the City of Tigard, and a copy of said final order has been
filed with the City Recorder; and
WHEREAS, the City of Tigard, in accordance with Chapter 197 Oregon Revised
Statutes, has adopted a Comprehensive Plan which includes the lands within this
annexation; and
WHEREAS, the City of Tigard has ratifiedthis annexation by Ordinance 80-28,
dated April 14 1980.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described are now zoned as
Washington County RU-4 and further finding that pursuant to ORS 197,
the City of Tigard has adopted a Comprehensive Plan for said lands on August 26, 1979,
and that ORS 197.175 requires cities to enact zoning ordinances to implement
their comprehensive plans, and further finding that pursuant to procedures, the
abovestated zoning map amendment was presented at a public hearing held by the
Tigard City Council on June 9, 1980 and all interested persons were afforded
an opportunity to be heard at this public hearing. The Council adopts the
following substantive findings:
(1) That this zone map amendment is in conformance with the
Comprehensive Plan designation on the NPO #1 Plan which
is a portion of the adopted Tigard Comprehensive Plan.

SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the
Tigard Municipal Code, this request for an amendment to the
Zone Map of the City of Tigard is hereby approved subject to provisions of
Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits
"A", ''L", and "C" attached and made a part of this Ordinance.

SECTION 3: Inasmuch as it is necessary for the peace, health and safety of
the people of the City of Tigard that the foregoing change in the
boundaries of the City and zone map amendment become a permanent part of the
City's records, an emergency is hereby declared to exist, and this Ordinance
shall be effective upon its passage by the Council, and approval by the Mayor.

ANNEXATION TITLE: HILLVIEW STREET , TIGARD RESOLUTION # 79-120

PROPERTY LOCATION: SW Hillview/104th (Wash. Co. Tax Map 2S1 2CC, Tax Lots 2800, 2900,
(see attached map) 3000, 3200, 3400, 3500)
PRESENT ZONING (WASHINGTON COUNTY) :—RU--4, Single Family
COMPREHENSIVE PLAN DESIGNATION: R-7, Urban Low Density Residential
PROPOSED DEVELOPMENT PLANS: All lots are presently occupied by single family dwellings.
A minor land partition (MLP 4-80) on Lot 3000 to create two ots meeting R-
requirements was .approved by the Planning Director on May 15, 1980. The owner
intends to construct a single family home on the new of adjoining t e cul- a-sac.
Depending on house location, other partitions could take place on the remaining lots.

PUBLIC SERVICE AVAILABILITY: A sewer L.I.D. is being formed to extend sewer service to
the cul-de-sac area from the northeast corner of Lot 1500 (N. of Hillview Street . Water
service is presently available. Hillview and 104th are local streets with adequate
right-of-way and unpaved conditions Faith no sidewalks.
STAFF RECOIAIMENDATIONS: Staff recommends approval of this zone change in order
to bring the zoning of this area into conformance with the Comprehensive Plan
designation. Public improvements to this area will be made by the sewer L.I.D.
and half-street improvements are required by the Minor Land Partition MLP 4-80.
The application of City standards to this area will be facilitated by re-zoning.
